OTTAWA — Noa Mendelsohn Aviv, Executive Director of the Canadian Civil Liberties Association (CCLA), made the following remarks today:
The government of Ontario is trying to pass a law that violates the Charter rights of Ontarians. Just a few years ago, a court decided that a different law that tried to impose a contract on workers violated the Charter and was unjustifiable.
This time, the Ontario government is using the notwithstanding clause to impose a contract and run roughshod over individual rights.
The notwithstanding clause was never meant to be used in contract negotiations, or as a casual tool to disrupt basic human rights safeguarded in our Charter. This misuse, and the flagrant disregard for individual rights is wrong and it is dangerous to our constitutional democracy.
