Ces mesures ont impos\u00e9 de vastes restrictions \u00e0 la libert\u00e9 de r\u00e9union et de manifestation des Canadiennes et des Canadiens. Elles ont permis au gouvernement d\u2019exiger la fourniture de certains services et le gel de biens personnels, sans pr\u00e9avis et sans respecter la proc\u00e9dure \u00e9tablie. Ces ordonnances ont conf\u00e9r\u00e9 des pouvoirs extraordinaires aux forces de l\u2019ordre et aux institutions financi\u00e8res. L\u2019intention du gouvernement \u00e9tait peut-\u00eatre que ces pouvoirs soient utilis\u00e9s de mani\u00e8re cibl\u00e9e, mais tels qu\u2019ils ont \u00e9t\u00e9 r\u00e9dig\u00e9s, ils ont donn\u00e9 aux forces de l\u2019ordre de tout le pays des mesures dont l\u2019application potentielle allait bien au-del\u00e0 des blocus et aurait pu mener facilement \u00e0 des abus.<\/p>\n<p>J\u2019ai trois arguments \u00e0 vous soumettre :<\/p>\n<p>Premi\u00e8rement : la Loi sur les mesures d\u2019urgence ne permet pas de suspendre les droits conf\u00e9r\u00e9s par la Charte, mais en l\u2019absence d\u2019\u00e9tat d\u2019urgence, les mesures qui ont \u00e9t\u00e9 adopt\u00e9es seraient tr\u00e8s certainement contraires \u00e0 la Charte. En l\u2019absence de circonstances \u00e9quivalant \u00e0 un \u00e9tat d\u2019urgence, elles constitueraient des restrictions graves aux droits et libert\u00e9s fondamentaux qui ne sont ni raisonnables ni justifi\u00e9es dans une soci\u00e9t\u00e9 libre et d\u00e9mocratique. La question de savoir s\u2019il y avait un \u00e9tat d\u2019urgence nationale qui justifiait ces mesures est donc cruciale. L\u2019Association canadienne des libert\u00e9s civiles all\u00e8gue respectueusement que cette question est importante non seulement pour ce qu\u2019elle r\u00e9v\u00e8le au sujet des \u00e9v\u00e9nements de janvier et f\u00e9vrier dernier, mais aussi pour le signal qu\u2019elle envoie aux gouvernements futurs en ce qui concerne les cas o\u00f9 des pouvoirs extraordinaires peuvent \u00eatre utilis\u00e9s et o\u00f9 le processus parlementaire peut \u00eatre contourn\u00e9 pour leur permettre de gouverner par d\u00e9cret.<\/p>\n<p>Deuxi\u00e8mement, le gouvernement du Canada a pr\u00e9sent\u00e9 une s\u00e9rie de justifications pour sa d\u00e9cision d\u2019invoquer la Loi. Sa principale justification \u2013 formul\u00e9e lorsque la Loi a \u00e9t\u00e9 invoqu\u00e9e pour la premi\u00e8re fois \u2013 est pr\u00e9sent\u00e9e dans son rapport pr\u00e9sent\u00e9 au Parlement en vertu de l\u2019article 58. Bien que la justification ait \u00e9volu\u00e9 au fil du temps, ses \u00e9l\u00e9ments fondamentaux sont relativement simples et demeurent pour la plupart intacts. La justification est tr\u00e8s fortement ax\u00e9e sur la perturbation et le tort \u00e9conomiques. Elle cite aussi des pr\u00e9occupations quant \u00e0 la possibilit\u00e9 de violences graves, soit en raison de la pr\u00e9sence de certains extr\u00e9mistes violents parmi des manifestants par ailleurs non violents, soit parce que les manifestations pourraient servir de couverture \u00e0 une attaque de type loup solitaire ou permettre aux auteurs de menaces de recruter des adeptes, soit encore parce que l\u2019on craint que des violences n\u2019\u00e9clatent lors d\u2019affrontements avec des contre-manifestants. Outre les pr\u00e9occupations d\u2019ordre \u00e9conomique, les preuves sur lesquelles le gouvernement s\u2019appuie pour \u00e9tayer ces affirmations sont extr\u00eamement minces. Les services de police et de renseignement dont l\u2019expertise devrait contribuer \u00e0 \u00e9clairer les d\u00e9cisions du gouvernement n\u2019ont pas estim\u00e9 que les manifestations donnaient lieu \u00e0 une menace s\u00e9rieuse de violence. L\u2019\u00e9l\u00e9ment le plus dangereux dont nous avons entendu parler \u2013 la cellule de Coutts avec une cache d\u2019armes \u2013 a fait l\u2019objet d\u2019une enqu\u00eate et a \u00e9t\u00e9 arr\u00eat\u00e9 par les forces de l\u2019ordre avant l\u2019entr\u00e9e en vigueur des ordonnances d\u2019urgence, sans recours \u00e0 des pouvoirs extraordinaires et sans d\u00e9clencher de r\u00e9action de violence en cha\u00eene parmi les manifestants.<\/p>\n<p>La Loi sur les mesures d\u2019urgence a \u00e9t\u00e9 soigneusement \u00e9labor\u00e9e de mani\u00e8re \u00e0 \u00e9viter les exc\u00e8s de la Loi sur les mesures de guerre qui l\u2019a pr\u00e9c\u00e9d\u00e9e. Le Parlement a intentionnellement d\u00e9clar\u00e9 l\u2019\u00e9tat d\u2019urgence en le liant exclusivement et exhaustivement \u00e0 la d\u00e9finition des menaces envers la s\u00e9curit\u00e9 du Canada \u00e9nonc\u00e9e dans la Loi sur le SCRS. Cette d\u00e9finition n\u2019inclut pas les torts ou les perturbations \u00e9conomiques, et ne devrait pas le faire. Elle requiert des activit\u00e9s qui visent \u00e0 favoriser l\u2019usage de la violence grave ou de menaces de violence contre des personnes ou des biens dans le but d\u2019atteindre un objectif politique, religieux ou id\u00e9ologique. Le seuil l\u00e9gal pour avoir recours \u00e0 la Loi n\u2019a pas \u00e9t\u00e9 atteint, et un avis juridique cr\u00e9atif et secret du gouvernement qui affirme le contraire n\u2019y change rien. Le premier ministre a convenu que le seuil n\u2019est pas inf\u00e9rieur \u00e0 la norme \u00e9tablie dans la Loi sur le SCRS. Le gouvernement a outrepass\u00e9 les limites de la Loi en prenant les mesures qu\u2019il a prises.<\/p>\n<p>Enfin, il ne fait aucun doute que les blocus et les manifestations ont caus\u00e9 de graves pr\u00e9judices aux personnes vivant dans les communaut\u00e9s o\u00f9 ils ont eu lieu, qu\u2019ils ont entra\u00een\u00e9 d\u2019importantes perturbations \u00e9conomiques et que les forces de l\u2019ordre n\u2019\u00e9taient pas bien pr\u00e9par\u00e9es \u00e0 y faire face. Le gouvernement avait de la difficult\u00e9 \u00e0 obtenir des renseignements des forces de l\u2019ordre au sujet de leurs intentions et h\u00e9sitait \u00e0 franchir une ligne floue qui risquait de compromettre l\u2019ind\u00e9pendance op\u00e9rationnelle de la police. Mais le gouvernement ressentait \u00e9galement une forte pression de faire quelque chose pour rem\u00e9dier \u00e0 la situation et \u00eatre per\u00e7u comme faisant quelque chose. Au lieu d\u2019\u00e9tablir des voies de communication claires et ad\u00e9quates, de tenir de franches discussions et de donner des instructions \u00e9crites \u00e0 la police sur les priorit\u00e9s strat\u00e9giques, le gouvernement a donn\u00e9 aux forces de l\u2019ordre le coup de pouce le plus gros \u2013 et le plus public \u2013 possible. Il a invoqu\u00e9 la Loi sur les mesures d\u2019urgence et a donn\u00e9 aux forces de l\u2019ordre des instruments nouveaux, tr\u00e8s \u00e9tendus et inutiles et un mandat politique clair pour les utiliser.<\/p>\n<p>L\u2019un des principes fondamentaux de l\u2019ACLC est la conviction que si un seul individu n\u2019est pas libre, personne n\u2019est libre. Nous demandons instamment \u00e0 la Commission de garder ce principe en t\u00eate alors qu\u2019elle se penche sur les agissements du gouvernement actuel et les agissements \u00e9ventuels de futurs gouvernements.<\/p>\n<\/div>\n<\/div>\n<div>\n<p>-30-<\/p>\n<p><strong>\u00c0 propos de l\u2019association canadienne sur les libert\u00e9s civiles<br \/>\n<\/strong>L\u2019ACLC est un organisme ind\u00e9pendant \u00e0 but non lucratif qui compte des partisans dans tout le pays.
