Mais comment savoir si les paroles ou les actions d&#039;un propri\u00e9taire franchissent les limites\u00a0? Les cours et les tribunaux des droits de la personne ont le dernier mot en la mati\u00e8re. En examinant des cas ant\u00e9rieurs, nous pouvons en apprendre beaucoup sur ce qui constitue une discrimination ill\u00e9gale en mati\u00e8re de logement.<\/p>\n<p>Les trois histoires ci-dessous sont des cas r\u00e9els o\u00f9 un locataire ou un locataire potentiel a intent\u00e9 une action en justice pour discrimination et a gagn\u00e9. Ces affaires contribueront \u00e0 fa\u00e7onner la fa\u00e7on dont les cours et tribunaux interpr\u00e8tent les futures contestations judiciaires portant sur des situations similaires.<\/p>\n<h4>Cas 1 : Taches<\/h4>\n\t<\/div>\n<\/div>\n\n\n\n<a class=\"nectar-button medium regular extra-color-1  regular-button\"  role=\"button\" style=\"\" target=\"_blank\" href=\"https:\/\/www.canlii.org\/en\/bc\/bchrt\/doc\/2020\/2020bchrt52\/2020bchrt52.html?searchUrlHash=AAAAAQAeZGlzY3JpbWluYXRpb24gaG91c2luZyB0ZW5hbmN5AAAAAAE&amp;resultIndex=8\" data-color-override=\"false\" data-hover-color-override=\"false\" data-hover-text-color-override=\"#fff\"><span>Lisez le cas ici!<\/span><\/a>\n<div class=\"wpb_text_column wpb_content_element\" >\n\t<div class=\"wpb_wrapper\">\n\t\t<p>Tribunal des droits de la personne de la Colombie-Britannique (2020)<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>QU&#039;EST-IL ARRIV\u00c9?<\/strong><\/span><br \/>\nMme Smith, une Autochtone, a lou\u00e9 un appartement \u00e0 M. Mohan. Mme Smith pratiquait r\u00e9guli\u00e8rement le maculage dans l&#039;appartement. La purification est une pratique culturelle et spirituelle autochtone impliquant la combustion d&#039;herbes sacr\u00e9es. Lorsque M. Mohan a d\u00e9couvert cela, il a commenc\u00e9 \u00e0 envoyer des messages persistants lui demandant de ne pas tacher, se plaignant de l&#039;odeur de fum\u00e9e et a menac\u00e9 de prendre des mesures pour mettre fin \u00e0 sa location. Il a fait valoir que l&#039;odeur de fum\u00e9e persistait dans l&#039;appartement voisin et craignait que l&#039;odeur ne reste en permanence. Il a tent\u00e9 \u00e0 plusieurs reprises de la faire quitter l&#039;appartement, notamment en tentant de l&#039;expulser et en lui disant qu&#039;il n&#039;accepterait plus ses paiements de loyer.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>PUBLIER\u00a0<\/strong><\/span><br \/>\nMme Smith a affirm\u00e9 que son logement avait \u00e9t\u00e9 affect\u00e9 n\u00e9gativement parce que M. Mohan avait fait preuve de discrimination \u00e0 son \u00e9gard en raison de sa race, de son ascendance, de son lieu d&#039;origine et de sa religion.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>CE QUE LE TRIBUNAL DES DROITS DE L&#039;HOMME A DIT\u00a0<\/strong><\/span><br \/>\nSelon le <em>Code des droits de la personne<\/em>, un propri\u00e9taire ne peut discriminer un locataire sur la base de sa race, de son ascendance, de son lieu d&#039;origine ou de sa religion. Pour Mme Smith, la purification \u00e9tait une expression de ces caract\u00e9ristiques. En interdisant la purification et en essayant d&#039;expulser Mme Smith alors qu&#039;elle continuait \u00e0 nettoyer, M. Mohan a eu un impact n\u00e9gatif sur la location de Mme Smith de mani\u00e8re discriminatoire.<\/p>\n<p>La r\u00e9action de M. Mohan aurait \u00e9t\u00e9 justifi\u00e9e s&#039;il avait prouv\u00e9 que le fait d&#039;accommoder la maculage de Mme Smith constituait une contrainte excessive (c&#039;est-\u00e0-dire d\u00e9raisonnablement difficile ou co\u00fbteuse). M. Mohan a soutenu que l&#039;odeur de fum\u00e9e provenant du maculage l&#039;obligerait \u00e0 remplacer tout le syst\u00e8me de chauffage et qu&#039;il s&#039;agissait d&#039;une contrainte excessive. Cependant, la preuve a montr\u00e9 que l&#039;odeur de fum\u00e9e n&#039;est rest\u00e9e que quelques heures avant de se dissiper. Le tribunal a conclu qu&#039;il existait de nombreuses solutions possibles pour faire face \u00e0 l&#039;odeur temporaire de fum\u00e9e qui ne causeraient pas de pr\u00e9judice injustifi\u00e9 \u00e0 M. Mohan.<\/p>\n<p>Le tribunal a conclu que les actions de M. Mohan \u00e9taient discriminatoires et ne pouvaient \u00eatre justifi\u00e9es.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>R\u00c9SOLUTION\u00a0<\/strong><\/span><br \/>\nM. Mohan a \u00e9t\u00e9 condamn\u00e9 \u00e0 payer un total de $23 300 \u00e0 Mme Smith pour compenser la perte de salaire et les d\u00e9penses encourues \u00e0 la suite de ses actions ainsi que l&#039;atteinte \u00e0 la dignit\u00e9, aux sentiments et au respect de soi de Mme Smith. Notez que cette r\u00e9compense refl\u00e8te \u00e9galement les multiples commentaires discriminatoires que M. Mohan a faits \u00e0 Mme Smith pendant plusieurs mois.<\/p>\n<h4>Cas 2 : Enfants<\/h4>\n\t<\/div>\n<\/div>\n\n\n\n<a class=\"nectar-button medium regular extra-color-1  regular-button\"  role=\"button\" style=\"\" target=\"_blank\" href=\"https:\/\/www.canlii.org\/en\/mb\/mbhrc\/doc\/2009\/2009canlii101328\/2009canlii101328.html?searchUrlHash=AAAAAQAeZGlzY3JpbWluYXRpb24gaG91c2luZyB0ZW5hbmN5AAAAAAE&amp;resultIndex=1\" data-color-override=\"false\" data-hover-color-override=\"false\" data-hover-text-color-override=\"#fff\"><span>Lisez le cas ici!<\/span><\/a>\n<div class=\"wpb_text_column wpb_content_element\" >\n\t<div class=\"wpb_wrapper\">\n\t\t<p>Commission des droits de la personne du Manitoba (2009)<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>QU&#039;EST-IL ARRIV\u00c9?\u00a0<\/strong><\/span><br \/>\nMme Hiebert cherchait un appartement \u00e0 louer pour elle et sa fille de cinq ans. Apr\u00e8s avoir vu une annonce pour une unit\u00e9 disponible, elle a contact\u00e9 un repr\u00e9sentant \u00e0 Amberwood Village, un complexe d&#039;appartements de trois \u00e9tages. On lui a dit qu&#039;elle et sa fille ne pouvaient pas louer le logement parce qu&#039;il se trouvait \u00e0 un \u00e9tage sup\u00e9rieur et qu&#039;ils avaient une politique limitant les enfants au rez-de-chauss\u00e9e uniquement. Cette politique visait \u00e0 limiter le bruit dans les unit\u00e9s voisines.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>PUBLIER\u00a0<\/strong><\/span><br \/>\nMme Hiebert a affirm\u00e9 que les gestionnaires immobiliers d&#039;Amberwood Village avaient fait preuve de discrimination \u00e0 son \u00e9gard en lui refusant la possibilit\u00e9 de louer un appartement en raison de sa situation familiale.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>CE QUE LE TRIBUNAL DES DROITS DE L&#039;HOMME A DIT\u00a0<\/strong><\/span><br \/>\nCette <em>Code des droits de la personne<\/em> interdit la discrimination en mati\u00e8re de logement fond\u00e9e sur la situation de famille. Lorsque Amberwood Village a refus\u00e9 \u00e0 Mme Hiebert une suite locative parce qu&#039;elle avait un jeune enfant, ils ont fait preuve de discrimination contre elle en raison de son statut de parent d&#039;un jeune enfant. Pour justifier cela, Amberwood Village aurait d\u00fb prouver que sa politique interdisant les enfants aux \u00e9tages sup\u00e9rieurs \u00e9tait n\u00e9cessaire pour atteindre l&#039;objectif de limiter le bruit excessif. Le tribunal a jug\u00e9 que la politique n&#039;\u00e9tait pas n\u00e9cessaire pour trois raisons. Premi\u00e8rement, il n&#039;y avait aucune donn\u00e9e sugg\u00e9rant que les plaintes pour bruit contre les enfants \u00e9taient en fait plus courantes que contre les adultes. Deuxi\u00e8mement, il y avait des alternatives disponibles \u00e0 la politique, comme demander des r\u00e9f\u00e9rences \u00e0 Mme Hiebert pour d\u00e9terminer les plaintes de bruit pass\u00e9es. Troisi\u00e8mement, d&#039;autres immeubles d&#039;appartements louent des logements de niveau sup\u00e9rieur \u00e0 des familles sans probl\u00e8me.<\/p>\n<p>Le tribunal a statu\u00e9 qu&#039;Amberwood Village avait exerc\u00e9 une discrimination injustifi\u00e9e \u00e0 l&#039;\u00e9gard de Mme Hiebert en raison de sa situation familiale.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>R\u00c9SOLUTION\u00a0<\/strong><\/span><br \/>\nAmberwood Village a d\u00fb payer $1000 \u00e0 Mme Hiebert pour atteinte \u00e0 la dignit\u00e9, aux sentiments et au respect de soi. Le tribunal a \u00e9galement ordonn\u00e9 qu&#039;Amberwood Village ne restreigne pas les familles au rez-de-chauss\u00e9e \u00e0 l&#039;avenir.<\/p>\n<h4>Cas 3 : Invalidit\u00e9<\/h4>\n\t<\/div>\n<\/div>\n\n\n\n<a class=\"nectar-button medium regular extra-color-1  regular-button\"  role=\"button\" style=\"\" target=\"_blank\" href=\"https:\/\/www.canlii.org\/en\/on\/onhrt\/doc\/2020\/2020hrto613\/2020hrto613.html?searchUrlHash=AAAAAQAeZGlzY3JpbWluYXRpb24gaG91c2luZyB0ZW5hbmN5AAAAAAE&amp;resultIndex=3\" data-color-override=\"false\" data-hover-color-override=\"false\" data-hover-text-color-override=\"#fff\"><span>Lisez le cas ici!<\/span><\/a>\n<div class=\"wpb_text_column wpb_content_element\" >\n\t<div class=\"wpb_wrapper\">\n\t\t<p>Tribunal des droits de la personne de l&#039;Ontario (2020)<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>QU&#039;EST-IL ARRIV\u00c9?<br \/>\n<\/strong><\/span>M. Howlett a lou\u00e9 cinq chambres dans sa maison, principalement \u00e0 des femmes qui avaient besoin d&#039;un espace de vie abordable et s\u00fbr. Mme McLaren, atteinte d&#039;une maladie auto-immune affectant sa mobilit\u00e9, a emm\u00e9nag\u00e9 dans l&#039;une de ces chambres. Pendant les quatre jours o\u00f9 elle a v\u00e9cu l\u00e0-bas, elle n&#039;a pas suivi les r\u00e8gles de la maison et s&#039;est comport\u00e9e de mani\u00e8re agressive envers les autres locataires. Le quatri\u00e8me jour, M. Howlett a gliss\u00e9 une note sous sa porte disant que la r\u00e9sidence de Mme McLaren \u00e0 la maison \u00e9tait termin\u00e9e. La raison invoqu\u00e9e \u00e9tait que la maison n&#039;\u00e9tait pas en mesure de fournir le type de soutien dont une personne handicap\u00e9e aurait besoin.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>PUBLIER<br \/>\n<\/strong><\/span>Mme McLaren a all\u00e9gu\u00e9 que M. Howlett avait fait preuve de discrimination \u00e0 son \u00e9gard en mati\u00e8re de logement en raison de son handicap.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>CE QUE LE TRIBUNAL DES DROITS DE L&#039;HOMME A DIT<br \/>\n<\/strong><\/span>Le Code des droits de la personne interdit la discrimination en mati\u00e8re de logement fond\u00e9e sur le handicap. Pour prouver la discrimination, Mme McLaren devait d\u00e9montrer que son handicap \u00e9tait un facteur dans la d\u00e9cision de mettre fin \u00e0 sa location, mais qu&#039;il n&#039;\u00e9tait pas n\u00e9cessaire que ce soit la raison principale. La note laiss\u00e9e par M. Howlett indiquait clairement que l&#039;invalidit\u00e9 de Mme McLaren \u00e9tait la raison de mettre fin \u00e0 sa location. Cependant, M. Howlett a t\u00e9moign\u00e9 que la v\u00e9ritable raison de mettre fin \u00e0 la location \u00e9tait le comportement de Mme McLaren; il a imput\u00e9 le licenciement au handicap uniquement dans une tentative malavis\u00e9e d&#039;\u00e9viter de blesser ses sentiments. Le tribunal a accept\u00e9 son t\u00e9moignage, mais a d\u00e9termin\u00e9 que le handicap de Mme McLaren avait tr\u00e8s probablement aussi jou\u00e9 un r\u00f4le dans le licenciement. Outre la note indiquant explicitement que son handicap en \u00e9tait la cause, il y avait des preuves que certaines des plaintes d&#039;autres locataires concernant le comportement de Mme McLaren \u00e9taient li\u00e9es \u00e0 son handicap. Comme cela a \u00e9t\u00e9 un facteur dans la r\u00e9siliation de sa location, le tribunal a conclu que M. Howlett avait fait preuve de discrimination \u00e0 l&#039;\u00e9gard de Mme McLaren en raison de son handicap.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>R\u00c9SOLUTION<br \/>\n<\/strong><\/span>M. Howlett a \u00e9t\u00e9 condamn\u00e9 \u00e0 payer \u00e0 Mme McLaren $1500 pour atteinte \u00e0 la dignit\u00e9, aux sentiments et au respect de soi.
