Je suis accompagn\u00e9e d&#039;Abby Deshman, directrice de notre programme de justice p\u00e9nale.<\/p>\n<p>L&#039;ACLC d\u00e9fend les droits et libert\u00e9s de toutes les personnes au Canada. Cela inclut les libert\u00e9s fondamentales en vertu de la <em>Charte<\/em>. Libert\u00e9 d&#039;expression. Libert\u00e9 de r\u00e9union pacifique. Libert\u00e9 d&#039;association. Notre d\u00e9mocratie ne d\u00e9pend pas seulement de ces droits et libert\u00e9s les plus fondamentaux, elle est soutenue par eux. Le projet de loi 100 met ces libert\u00e9s, la pierre angulaire de notre d\u00e9mocratie, en danger. L&#039;ACLC croit que le projet de loi devrait \u00eatre retir\u00e9 ou que des amendements substantiels devraient \u00eatre introduits pour le rendre conforme \u00e0 notre Constitution.<\/p>\n<p>La loi 100 est une sur-correction. Une r\u00e9ponse rapide au blocus du pont Ambassador et \u00e0 l&#039;occupation du centre-ville d&#039;Ottawa plus t\u00f4t cette ann\u00e9e. Il a un attrait superficiel, \u00e9tant donn\u00e9 les ravages caus\u00e9s par ces incidents. Plut\u00f4t que de combler une lacune dans la loi, cependant, le projet de loi 100 reproduit les interdictions existantes en termes larges et ambigus et \u00e9tend les pouvoirs de la police au-del\u00e0 des limites constitutionnelles. Bien que le gouvernement puisse avoir des blocus particuliers \u00e0 l&#039;esprit, ce projet de loi risque de criminaliser un groupe beaucoup plus large, y compris les Autochtones, les Noirs et d&#039;autres personnes racialis\u00e9es qui critiquent le gouvernement, les mauvaises conditions de travail, ainsi que les riches et les puissants.<\/p>\n<p>Premi\u00e8rement, le projet de loi 100 ne comble pas une lacune de la loi. Il est d\u00e9j\u00e0 ill\u00e9gal d&#039;occuper les rues de la ville ou d&#039;obstruer un passage frontalier pendant des jours. En supposant que toute \u00ab\u00a0infrastructure de transport prot\u00e9g\u00e9e\u00a0\u00bb est un bien, l&#039;obstruction ou l&#039;interf\u00e9rence avec l&#039;utilisation l\u00e9gale de ce bien, par d\u00e9finition, est un m\u00e9fait en vertu de l&#039;article 430 de la <em>Code criminel<\/em>, ind\u00e9pendamment du fait qu&#039;il \u00ab entrave \u00e9galement l&#039;activit\u00e9 \u00e9conomique ordinaire \u00bb ou met en danger les autres comme l&#039;exigerait le projet de loi 100, conform\u00e9ment au paragraphe 2(1). Dans les cas les plus graves, lorsqu&#039;il existe un risque r\u00e9el de violence, le droit p\u00e9nal va encore plus loin et interdit les rassemblements ill\u00e9gaux et les \u00e9meutes, comme indiqu\u00e9 dans la partie II de la <em>Code criminel<\/em>. La police a des pouvoirs d&#039;arrestation pour faire appliquer ces lois. En fin de compte, ces infractions sont soumises au pouvoir discr\u00e9tionnaire de la police et du minist\u00e8re public, qui doit \u00eatre exerc\u00e9 conform\u00e9ment \u00e0 l&#039;int\u00e9r\u00eat public. Ce pouvoir discr\u00e9tionnaire comprend d\u00e9j\u00e0 l&#039;examen des types d&#039;impacts \u00e9conomiques soulign\u00e9s dans le projet de loi 100, ainsi que l&#039;importance de la dissidence. La duplication de la l\u00e9gislation existante complique inutilement la loi, la rendant moins accessible.<\/p>\n<p>Deuxi\u00e8mement, en fait, le projet de loi empi\u00e8te sur le droit de manifester pacifiquement. En d\u00e9finissant les interdictions de l&#039;article 2 du projet de loi en termes d&#039;interf\u00e9rence avec \u00abl&#039;usage ordinaire\u00bb des infrastructures de transport prot\u00e9g\u00e9es, il va au-del\u00e0 de ce qui est n\u00e9cessaire pour maintenir l&#039;ordre public et ne tient pas compte des manifestations qui g\u00eanent ou causent des perturbations. Tenir t\u00eate au pouvoir est souvent perturbateur. Les gr\u00e8ves et les lignes de piquetage, par exemple, sont con\u00e7ues pour faire pression sur les employeurs par le biais d&#039;une action collective. Il y a une raison pour laquelle les rassemblements utilisent des m\u00e9gaphones pour effectuer des changements, pas par courtoisie. Les riches et les puissants, y compris le gouvernement, n&#039;\u00e9couteraient autrement jamais certaines voix. Pour la m\u00eame raison, les d\u00e9fenseurs des terres autochtones se sont livr\u00e9s \u00e0 des barrages ferroviaires pr\u00e8s du territoire mohawk de Tyendinaga entre Toronto et Montr\u00e9al en 2020, les militants du climat ont caus\u00e9 des retards \u00e0 l&#039;a\u00e9roport Pearson de Toronto \u00e0 l&#039;automne et les manifestations de George Floyd se sont propag\u00e9es \u00e0 travers le monde. Parfois, demander le changement poliment, avec le sourire, est pr\u00e9cis\u00e9ment le genre de pens\u00e9e qui contribue aux conditions en question.<\/p>\n<p>Dans le m\u00eame ordre d&#039;id\u00e9es, les exceptions pour les obstructions mineures ou \u00ab facilement \u00e9vitables \u00bb au paragraphe 2(3) introduisent un \u00e9l\u00e9ment d&#039;incertitude dans la loi. La norme de \u00ab\u00a0facilit\u00e9\u00a0\u00bb est tr\u00e8s subjective. Si une manifestation peut \u00eatre \u00e9vit\u00e9e avec un d\u00e9tour de dix minutes, est-elle \u00ab facilement \u00e9vitable \u00bb ? En voiture? \u00c0 pied? En fauteuil roulant dans la neige ? Dans une communaut\u00e9 \u00e9loign\u00e9e ou autochtone, o\u00f9 il peut n&#039;y avoir qu&#039;une seule route, un obstacle peut ne jamais \u00eatre \u00ab\u00a0facilement \u00e9vitable\u00a0\u00bb. Pourtant, le droit de manifester ne se limite pas aux pelouses de Queen&#039;s Park et de la colline du Parlement. L&#039;expression d\u00e9mocratique est \u00e9galement prot\u00e9g\u00e9e dans les communaut\u00e9s rurales. Pour toutes ces raisons, l&#039;ACLC croit que le projet de loi 100 porte atteinte aux libert\u00e9s fondamentales et aux droits \u00e0 l&#039;\u00e9galit\u00e9.<\/p>\n<p>Enfin, l&#039;ACLC croit que les pouvoirs de la police ne doivent pas \u00eatre \u00e9largis \u00e0 la l\u00e9g\u00e8re, ce qui est d&#039;autant plus difficile \u00e0 justifier ici que la police n&#039;a pas \u00e9puis\u00e9 les outils d\u00e9j\u00e0 \u00e0 sa disposition. Le projet de loi donnerait \u00e0 la police le pouvoir de saisir des objets et des v\u00e9hicules et de suspendre les permis de conduire. L&#039;ACLC est particuli\u00e8rement pr\u00e9occup\u00e9e par les pouvoirs de suspension routi\u00e8re propos\u00e9s en vertu de l&#039;article 7 du projet de loi. Contrairement aux dispositions de la <em>Code de la route<\/em> pour avoir \u00e9chou\u00e9 \u00e0 un alcootest, le projet de loi 100 ne s&#039;appuie sur aucune mesure empirique, mais sur la norme beaucoup plus souple des \u00abmotifs raisonnables de croire\u00bb, telle qu&#039;\u00e9valu\u00e9e par un seul policier. Ces pouvoirs soul\u00e8vent d&#039;importantes questions quant \u00e0 la constitutionnalit\u00e9 du projet de loi en vertu des articles 2, 7, 8 et 9 de la <em>Charte<\/em>.<\/p>\n<p>Au nom de l&#039;ACLC, j&#039;exhorte ce comit\u00e9 \u00e0 consid\u00e9rer la situation dans son ensemble. Les droits sont des relations sociales qui permettent ou limitent l&#039;action des personnes les unes par rapport aux autres. L&#039;ACLC reconna\u00eet que les droits de manifester ont des limites. Dans une soci\u00e9t\u00e9 libre et d\u00e9mocratique, il doit y avoir de la place pour contester l&#039;autorit\u00e9, y compris par la perturbation, sans accorder la permission de cr\u00e9er un pand\u00e9monium et un chaos g\u00e9n\u00e9ralis\u00e9s. Le projet de loi 100 s&#039;\u00e9carte de cet \u00e9quilibre d\u00e9mocratique, limitant les droits de manifestation dans un large \u00e9ventail d&#039;endroits jusqu&#039;\u00e0 leur extinction. Le projet de loi devrait \u00eatre retir\u00e9 ou d&#039;importants amendements apport\u00e9s pour garantir sa constitutionnalit\u00e9.<\/p>\n<p>Ceci conclut mes observations.
