CCLA argues that this approach does not further public health objectives and may\u00a0actual\u00a0undermine these objectives. We have urged the Minister to change the policy.<\/em><\/p>\n<p>++++++<\/p>\n<p>November 1, 2021<\/p>\n<p>Honourable\u00a0Carla Qualtrough<br \/>\nMinister of Employment, Workforce Development and Disability Inclusion<br \/>\nHouse of Commons<br \/>\nOttawa, ON K1A 0A6<br \/>\ncarla.qualtrough@parl.gc.ca<\/p>\n<p><strong>Delivered by Email\u00a0<\/strong><\/p>\n<p><strong>RE:\u00a0\u00a0Denial of Employment Insurance based on vaccination status\u00a0<\/strong><\/p>\n<p>Dear\u00a0Minister\u00a0Qualtrough,<\/p>\n<p>I am writing on behalf of the Canadian Civil Liberties Association (CCLA) regarding\u00a0comments\u00a0you have\u00a0made\u00a0in the media and\u00a0information on the Employment Insurance\u00a0(EI)\u00a0website about eligibility for\u00a0EI. As you know, the position\u00a0stated\u00a0is that if an individual is terminated for failing to comply with an employer\u2019s vaccination mandate, the individual will\u00a0not be considered eligible for employment benefits. In effect, a refusal to be vaccinated, or to disclose one\u2019s vaccination status to an employer, is treated as misconduct. In our view, this\u00a0policy is\u00a0wrong-headed,\u00a0counter-productive, and may well conflict with\u00a0the government\u2019s constitutional and human rights obligations. We strongly urge you to reconsider\u00a0this position.<\/p>\n<p>Vaccination mandates in workplaces are\u00a0not a simple question of occupational health and safety.\u00a0\u00a0The\u00a0federal government, for example,\u00a0is requiring employees\u00a0who work remotely to provide an attestation that they are vaccinated,\u00a0or face termination.\u00a0Applying this policy to an\u00a0employee who does not physically interact with other employees cannot be said to be required\u00a0based on health and safety\u00a0or employment-related\u00a0concerns.\u00a0Rather, the federal government itself appears to be using its role as the largest employer in the country to encourage or \u201cincentivize\u201d vaccine uptake. We are aware of other employers who are also requiring vaccination of individuals who do not ever physically enter a communal workplace.<\/p>\n<p>We accept that encouraging individuals to be vaccinated is\u00a0a valid policy\u00a0objective, but it cannot be pursued without limits.\u00a0Individuals who are willing to lose their jobs rather than accept the vaccine\u00a0clearly have a genuine\u00a0and sincerely held\u00a0objection.\u00a0While it may be easy to try to dismiss all such individuals and\u00a0assume that their hesitancy is premised on misinformation, we know that this is not true of all individuals who refuse the vaccine.\u00a0We are aware of some individuals, for example,\u00a0who have been advised by their physicians\u00a0not to be vaccinated\u00a0based on complex\u00a0personal\u00a0health issues. However,\u00a0many\u00a0employers, including the federal government,\u00a0do\u00a0not appear willing to accept this as a valid medical exemption.\u00a0As the Minister responsible for disability inclusion, your office should be particularly sensitive to this issue and the concerns that many members of the disability community have about the inflexible approach being taken to medical exemptions.<\/p>\n<p>There is a point at which\u00a0encouragement and incentives become\u00a0de facto\u00a0coercion. In our view, denying employment insurance benefits to individuals who have lost their job rather than\u00a0comply with a vaccine mandate crosses this line.\u00a0Further,\u00a0since poverty is one of the key social determinants of health,\u00a0such an approach may well be counter-productive from a\u00a0public\u00a0health perspective.\u00a0Finally, the individual\u00a0circumstances of those who may be denied EI as a result of this policy may give rise to\u00a0Charter\u00a0or human rights claims.\u00a0We\u00a0strongly\u00a0urge you to reconsider your government\u2019s approach to this issue.
