Le 31 mars, la province a publi\u00e9 un nouveau d\u00e9cret en conseil d&#039;urgence qui permet aux policiers et aux agents d&#039;application des r\u00e8glements d&#039;exiger votre nom, votre adresse et votre date de naissance s&#039;ils ont des motifs raisonnables et probables de croire que vous avez enfreint l&#039;une des nombreuses nouvelles mesures d&#039;urgence. ordres. De plus, l&#039;Ordre pr\u00e9cise que si la demande a \u00e9t\u00e9 faite, vous devez vous y conformer\u00a0; tandis que les nombreuses protections contre le fichage que les communaut\u00e9s et les militants (et l&#039;ACLC) luttent depuis des ann\u00e9es ne sont nulle part en vue.<\/p>\n<p>Bien que nous comprenions certainement l&#039;\u00e9normit\u00e9 de la pand\u00e9mie et de la t\u00e2che de la province pour essayer de la contenir, autoriser la police et les agents des r\u00e8glements municipaux ce genre de pouvoir, sans autre contrainte, sans responsabilit\u00e9 et sans protection de la vie priv\u00e9e, pourrait conduire \u00e0 une police de masse base de donn\u00e9es des proportions que cette province n&#039;a jamais vues auparavant.<\/p>\n<p>Apr\u00e8s tout, alors que la norme des \u00ab motifs raisonnables et probables \u00bb est assez claire, les restrictions dans les ordonnances d&#039;urgence sont tout sauf. Il n&#039;est peut-\u00eatre pas difficile de nos jours d&#039;enfreindre \u2013 ou de para\u00eetre enfreindre \u2013 l&#039;une des nombreuses nouvelles r\u00e8gles, que ce soit en \u00e9tant \u00e0 l&#039;ext\u00e9rieur avec sa famille, en s&#039;arr\u00eatant \u00e0 une distance de s\u00e9curit\u00e9 pour saluer un voisin ou en faisant son exercice quotidien dans un quartier dens\u00e9ment peupl\u00e9. Comment les policiers et les agents des r\u00e8glements (peut-\u00eatre moins bien form\u00e9s) le sauront-ils? Plus pr\u00e9occupant encore : comment les individus et le public sauront-ils si une loi a \u00e9t\u00e9 viol\u00e9e, ou si la norme requise des motifs raisonnables et probables a \u00e9t\u00e9 respect\u00e9e ? En l&#039;absence de mesures de reddition de comptes, est-ce que quelqu&#039;un cherchera \u00e0 voir si l&#039;agent avait raison ou tort\u00a0? s&#039;ils agissaient par parti pris inconscient ? Si les agents ne sont pas tenus de conserver des dossiers sur leur propre conduite - y compris qui ils arr\u00eatent - et s&#039;il n&#039;y a pas d&#039;exigence de signalement public, comment pouvons-nous nous assurer que les agents n&#039;arr\u00eatent pas de mani\u00e8re disproportionn\u00e9e les personnes racialis\u00e9es, souffrant de troubles de sant\u00e9 mentale ou est un jeune avec un style vestimentaire particulier ? Sans transparence, comment savoir o\u00f9 les agents sont d\u00e9ploy\u00e9s, sur quelle base et quelles mesures (le cas \u00e9ch\u00e9ant) sont utilis\u00e9es pour pr\u00e9venir la discrimination.<\/p>\n<p>Une fois qu&#039;une demande a \u00e9t\u00e9 donn\u00e9e, l&#039;individu doit s&#039;y conformer, mais l&#039;ordonnance d&#039;urgence \u00e9non\u00e7ant cette exigence douteuse n&#039;exige pas que les agents informent les gens de la raison de l&#039;arr\u00eat\u00a0; ou de leur fournir une copie conforme des informations enregistr\u00e9es \u2013 pas m\u00eame un re\u00e7u avec le nom de l&#039;agent, et encore moins des liens vers des informations sur les plaintes, la vie priv\u00e9e et les droits de l&#039;homme. Si les agents ne sont pas tenus d&#039;enregistrer la raison de l&#039;interpellation et son r\u00e9sultat, et s&#039;il n&#039;y a pas de transparence, comment le public peut-il savoir si cette activit\u00e9 \u00e9tait pour un motif l\u00e9gitime ?<\/p>\n<p>Plus pr\u00e9occupant encore, une fois les donn\u00e9es collect\u00e9es, l&#039;ordonnance d&#039;urgence ne dit rien sur l&#039;endroit o\u00f9 elles seront stock\u00e9es, pendant combien de temps et comment les faire effacer (le cas \u00e9ch\u00e9ant).<\/p>\n<p>Dans la lutte contre une pand\u00e9mie, la collecte de donn\u00e9es individuelles en masse n&#039;est pas la seule option, et on peut se demander \u00e0 quel point cela peut \u00eatre utile ou efficace. Sans cet arr\u00eat\u00e9, les agents peuvent toujours \u00e9duquer, avertir, disperser des rassemblements et entreprendre d&#039;autres formes de maintien de l&#039;ordre raisonnable, et les agents de police peuvent toujours arr\u00eater des individus si n\u00e9cessaire.<\/p>\n<p>Au mieux, ce nouvel Ordre est imprudent et dangereux. Au pire, cela pourrait \u00eatre per\u00e7u comme une tentative effront\u00e9e de r\u00e9animer le fichage et de reconstituer une base de donn\u00e9es avec des informations sur les habitants de cette ville, et en particulier sur les personnes racialis\u00e9es, autochtones, sans-abri, ayant des probl\u00e8mes de sant\u00e9 mentale ou sont par ailleurs marginalis\u00e9s.<\/p>\n<p>L&#039;ACLC et bien d&#039;autres ont lutt\u00e9 longtemps et durement contre le profilage racial et social.
