Pendant cette p\u00e9riode critique, nous comprenons que les ressources sont tendues, que le temps presse et que de nouveaux pouvoirs peuvent \u00eatre n\u00e9cessaires. Malheureusement, le nouveau d\u00e9cret a cr\u00e9\u00e9 un pouvoir qui permet aux agents \u2013 y compris les agents de police et les agents des r\u00e8glements municipaux \u2013 d&#039;enregistrer et de profiler, n&#039;inclut pas les pr\u00e9cautions n\u00e9cessaires et n&#039;inclut pas de mesures de responsabilisation qui pourraient aider \u00e0 assurer au public que la police et le r\u00e8glement les agents exercent leur autorit\u00e9 de mani\u00e8re juste et \u00e9quitable.<\/p>\n<p>Comme vous le savez, les pr\u00e9occupations concernant le fichage, le profilage racial et social ont entra\u00een\u00e9 une grave crise de m\u00e9fiance et des inqui\u00e9tudes \u00e0 l&#039;\u00e9gard des services de police dans des endroits de l&#039;Ontario, d&#039;Ottawa \u00e0 Peel, de Toronto \u00e0 Thunder Bay. La discrimination, m\u00eame lorsqu&#039;elle repose sur des structures institutionnelles syst\u00e9miques ou sur des pr\u00e9jug\u00e9s inconscients, est pr\u00e9judiciable aux individus et aux communaut\u00e9s, tandis que la m\u00e9fiance est pr\u00e9judiciable \u00e0 un maintien de l&#039;ordre efficace. Pour vaincre le nouveau coronavirus, la confiance et la collaboration sont plus importantes que jamais.<\/p>\n<p>Malheureusement, le nouveau d\u00e9cret d&#039;urgence mentionn\u00e9 ci-dessus autorise les policiers et autres agents des infractions provinciales, y compris les agents des r\u00e8glements municipaux, \u00e0 arr\u00eater un grand nombre de personnes, \u00e0 exiger et \u00e0 enregistrer leurs nom, adresse et date de naissance. Bien que ce pouvoir semble \u00eatre clairement d\u00e9fini, car il s&#039;applique aux situations o\u00f9 un agent a des \u00ab motifs raisonnables et probables \u00bb de croire qu&#039;une personne a viol\u00e9 l&#039;un des ordres d&#039;urgence, la r\u00e9alit\u00e9 de ces ordres est qu&#039;ils sont extr\u00eamement larges et incertains. Comment un agent peut-il savoir si un groupe de personnes dans la rue (ou m\u00eame dans leur propre maison) est une grande famille ou un \u00ab\u00a0rassemblement social\u00a0\u00bb de plus de 5\u00a0personnes\u00a0? Et comment font-ils la distinction entre un rassemblement et des individus qui se saluent tout en emmenant leurs enfants faire de l&#039;exercice quotidien ? Est-ce que chaque officier et officier municipal est capable de juger une distance de 2 m\u00e8tres? Ces incertitudes et d&#039;autres seront exacerb\u00e9es dans les quartiers dens\u00e9ment peupl\u00e9s, et o\u00f9 les individus vivent dans des immeubles d&#039;habitation sans cour arri\u00e8re.<\/p>\n<p>En bref, la norme des \u00ab motifs raisonnables et probables \u00bb devient floue lorsqu&#039;elle est fond\u00e9e sur des restrictions sous-jacentes peu claires, donnant aux agents une grande latitude en vertu du nouveau d\u00e9cret pour arr\u00eater des individus et exiger leurs informations. Et sans mesures de responsabilisation, comment un individu et sa communaut\u00e9 peuvent-ils savoir si l&#039;agent \u00e9tait correct ou m\u00eame raisonnable, s&#039;il a exerc\u00e9 ce pouvoir discr\u00e9tionnaire de mani\u00e8re appropri\u00e9e et \u00e9quitable, ou l&#039;a fait sur la base d&#039;un parti pris inconscient, d&#039;une discrimination syst\u00e9mique ou m\u00eame pour des motifs ill\u00e9gaux ?<\/p>\n<p>Si la crise du covid se poursuit pendant plusieurs mois, et si cette ordonnance est prolong\u00e9e pendant cette p\u00e9riode sans contraintes, protections de la vie priv\u00e9e et mesures de responsabilit\u00e9, elle pourrait conduire \u00e0 une base de donn\u00e9es polici\u00e8re de masse bas\u00e9e sur ces motifs larges et incertains. Les efforts d\u00e9ploy\u00e9s ces derni\u00e8res ann\u00e9es pour cr\u00e9er une police de proximit\u00e9 efficace et instaurer la confiance avec les communaut\u00e9s marginalis\u00e9es pourraient \u00eatre s\u00e9rieusement compromis.<\/p>\n<p>Pour r\u00e9pondre \u00e0 ces pr\u00e9occupations et prot\u00e9ger les droits des personnes, nous vous demandons de prendre sans d\u00e9lai les mesures suivantes\u00a0:<\/p>\n<p>A. Modifier l&#039;ordonnance et donner des instructions aux services de police et \u00e0 toute autre autorit\u00e9 collectant et\/ou conservant des donn\u00e9es en vertu de la pr\u00e9sente ordonnance comme suit\u00a0:<\/p>\n<ul>\n<li>Toute information recueillie en vertu de la pr\u00e9sente ordonnance ne doit pas \u00eatre conserv\u00e9e sauf si n\u00e9cessaire, et si elle est conserv\u00e9e, doit \u00eatre conserv\u00e9e avec des protections de confidentialit\u00e9 appropri\u00e9es, y compris des restrictions de partage, et supprim\u00e9e dans les plus brefs d\u00e9lais, et au plus tard \u00e0 la fin de l&#039;urgence covid\u00a0;<\/li>\n<li>Si elles sont conserv\u00e9es pendant une p\u00e9riode quelconque, les donn\u00e9es collect\u00e9es en vertu de la pr\u00e9sente commande doivent \u00eatre clairement identifi\u00e9es comme telles et s\u00e9par\u00e9es de toutes les donn\u00e9es non li\u00e9es \u00e0 la covid, afin de prot\u00e9ger la vie priv\u00e9e des individus et de garantir qu&#039;elles peuvent \u00eatre facilement localis\u00e9es et supprim\u00e9es comme ci-dessus. que pendant la crise des cartes de la ville de Toronto, les services de police de Toronto ont affirm\u00e9 qu&#039;ils n&#039;\u00e9taient pas en mesure d&#039;effacer les donn\u00e9es historiques des cartes en raison du fait que les donn\u00e9es \u00e9taient toutes regroup\u00e9es dans une seule base de donn\u00e9es et seraient difficiles \u00e0 localiser. Il incombe \u00e0 la police et \u00e0 toute autre autorit\u00e9 susceptible de collecter et\/ou de conserver des donn\u00e9es en vertu du pr\u00e9sent arr\u00eat\u00e9 de prendre des mesures imm\u00e9diates pour \u00e9viter de telles difficult\u00e9s \u00e0 l&#039;avenir.<\/li>\n<\/ul>\n<p>B. Exiger au minimum que les services de police et autres autorit\u00e9s comp\u00e9tentes prennent les mesures de responsabilisation suivantes\u00a0:<\/p>\n<ul>\n<li>Les agents doivent informer les personnes du motif de l&#039;interpellation et de la demande de renseignements.<\/li>\n<li>Si les agents enregistrent des donn\u00e9es sur une personne, l&#039;agent doit \u00e9galement enregistrer la race per\u00e7ue de la personne, si la personne semble \u00eatre autochtone et si la personne semble \u00eatre sans abri ou avoir un probl\u00e8me de sant\u00e9 mentale\u00a0;<\/li>\n<li>Fournissez \u00e0 la personne une copie carbone des informations enregistr\u00e9es sur cette personne. La copie doit \u00e9galement comprendre le nom de l&#039;agent, le num\u00e9ro de badge ou l&#039;\u00e9quivalent, ainsi que le motif de l&#039;arr\u00eat\u00a0;<\/li>\n<li>Tenir des registres sur o\u00f9 et quand les agents sont d\u00e9ploy\u00e9s, et pour quelle raison\u00a0;<\/li>\n<li>Cr\u00e9er et mettre en \u0153uvre des mesures pour s&#039;assurer que cette ordonnance d&#039;urgence et d&#039;autres seront mises en \u0153uvre de mani\u00e8re \u00e0 promouvoir des services de police et une prestation de services justes, \u00e9quitables et non discriminatoires.<\/li>\n<li>D\u00e8s que possible \u00e0 la lumi\u00e8re de la crise, chaque service de police et autre autorit\u00e9 comp\u00e9tente doit publier de mani\u00e8re proactive\u00a0:\n<ul>\n<li>Leurs pratiques et politiques en mati\u00e8re de collecte, de conservation, de confidentialit\u00e9 et de suppression des donn\u00e9es li\u00e9es \u00e0 Covid\u00a0;<\/li>\n<li>Informations anonymes sur les interactions et les r\u00e9sultats de ces interactions, y compris quand les donn\u00e9es ont \u00e9t\u00e9 collect\u00e9es et quand elles ont donn\u00e9 lieu \u00e0 des avertissements, des amendes, des contraventions et des arrestations. Les informations devraient \u00eatre d\u00e9sagr\u00e9g\u00e9es pour permettre l&#039;analyse de l&#039;effet des ordonnances d&#039;urgence, y compris l&#039;effet de cette nouvelle ordonnance, sur les individus en fonction de la race, de l&#039;indig\u00e9n\u00e9it\u00e9, de la sant\u00e9 mentale et de l&#039;itin\u00e9rance.<\/li>\n<li>Mesures qu&#039;ils ont prises pour promouvoir une police et une prestation de services justes, \u00e9quitables et non discriminatoires.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Dans la lutte contre une pand\u00e9mie, la collecte et la conservation de donn\u00e9es individuelles de masse n&#039;est pas la seule option, et on peut se demander \u00e0 quel point cela peut \u00eatre utile ou efficace.
