T<\/b>he Ontario\u00a0government\u00a0is making a\u00a0grab for more permanent\u00a0emergency powers while cutting democratic\u00a0controls<\/b><\/span><\/u><\/span><\/h3>\n

On Tuesday, July 7<\/span><\/span>th<\/span><\/sup><\/span>, Ontario\u2019s government\u00a0introduced Bill 195, the\u00a0Reopening Ontario Act (A Flexible Response to COVID-19) Act 2020.\u00a0<\/i>This\u00a0Bill\u00a0would\u00a0effectively allow the provincial government to\u00a0continue its extraordinary powers\u00a0\u2013\u00a0currently being exercised\u00a0under the\u00a0Emergency Management and Civil Protection Act\u00a0(EMCPA<\/i>)\u00a0\u2013\u00a0except without the need for an ongoing public health emergency\u00a0and without the oversight and accountability mechanisms that are crucial\u00a0when power is concentrated in the executive branch\u00a0(the Premier and Cabinet).\u00a0<\/span><\/span>\u00a0<\/u><\/u><\/span><\/span><\/p>\n

Right now, the government has to return to the Legislative Assembly every 28 days if it wants to extend the state of emergency. It\u2019s a way to insert democratic control over\u00a0the\u00a0executive branch\u2019s\u00a0emergency\u00a0powers and\u00a0the\u00a0orders\u00a0the\u00a0Premier and Ministers\u00a0make\u00a0in response to\u00a0an\u00a0emergency. Bill 195 eliminates this requirement\u00a0\u2013 leaving no\u00a0meaningful\u00a0democratic\u00a0check on the government\u2019s\u00a0power.\u00a0<\/span><\/span>\u00a0<\/u><\/u><\/span><\/p>\n

The Bill would\u00a0allow\u00a0current emergency orders to remain in place without a formal declaration of a state of emergency. It also allows\u00a0individual Ministers to extend, amend, or revoke some of the emergency orders that are currently in force.\u00a0The Bill\u2019s definition of an amendment is excessively broad and includes imposing \u201cmore onerous or different requirements\u201d and \u201cextending\u201d the application of the order being amended including its \u201cgeographic scope and the persons it applies to\u201d. Orders can be amended to have retroactive effect.\u00a0<\/span><\/span>\u00a0<\/u><\/u><\/span><\/p>\n

In essence,\u00a0Bill\u00a0195 would\u00a0give\u00a0the\u00a0Premier and Ministers\u00a0the power to\u00a0impose\u00a0emergency\u00a0orders\u00a0that drastically curtail basic rights and freedoms\u00a0without the need to engage in the legislative process\u00a0or involve members of the Legislative Assembly.\u00a0<\/span><\/b><\/span>\u00a0<\/u><\/u><\/span><\/span><\/p>\n

This ability \u2013 to exercise emergency powers without the label of an \u201cemergency\u201d\u00a0or the checks and balances that come with it\u00a0\u2013 would last for at least a year\u00a0and can be extended by the Legislative Assembly\u00a0for a year at a time. Indefinitely. The powers governments have under emergency legislation are supposed to be exceptional \u2013 Bill 195\u00a0would make the exercise of those powers the \u201cnew normal\u201d.\u00a0\u00a0\u00a0\u00a0<\/span><\/span>\u00a0<\/u><\/u><\/span><\/p>\n

CCLA has significant\u00a0concerns about the\u00a0Reopening Ontario Act<\/i>\u00a0\u2013 it\u00a0has\u00a0an illegitimate purpose and is\u00a0seriously flawed.\u00a0There is no need for this Bill\u00a0\u2013 Ontario\u2019s existing emergency legislation gives the government all the tools it needs to respond to the pandemic.\u00a0The government is simply trying to keep the power while cutting democratic oversight.\u00a0<\/span><\/span>\u00a0<\/u><\/u><\/span><\/p>\n
