Suite aux recommandations de la Commission, le Canada <a href=\"http:\/\/epe.lac-bac.gc.ca\/100\/200\/301\/pco-bcp\/commissions-ef\/mcdonald1979-81-eng\/mcdonald1979-81-eng.htm\" target=\"_blank\" rel=\"noopener\">a<\/a> s\u00e9par\u00e9 les agences responsables des activit\u00e9s de collecte de renseignements de celles responsables de l\u2019application de la loi, de la collecte de preuves et de la pr\u00e9vention des crimes. Cette division des responsabilit\u00e9s reconnaissait que les deux objectifs entrent parfois en conflit, et que faire les deux place beaucoup de pouvoir et de fortes incitations \u00e0 l\u2019abus entre les mains d\u2019une seule agence potentiellement faillible.  <\/p>\n<p>En 2015, cette ligne s\u2019est de nouveau estomp\u00e9e lorsque le SCRS a re\u00e7u un nouvel ensemble de \u00ab pouvoirs de perturbation des menaces \u00bb en vertu du projet de loi C-51, leur permettant non seulement de recueillir des renseignements, mais d\u2019agir en cons\u00e9quence, permettant soudainement aux agents du SCRS, par exemple, d\u2019interrompre un transfert d\u2019argent ou de planter un document falsifi\u00e9. Les seules limites impos\u00e9es au SCRS : il leur \u00e9tait interdit de tuer; d\u2019entraver ou de perturber le cours de la justice; ou pour violer l\u2019int\u00e9grit\u00e9 sexuelle d\u2019une personne. Le C-51 a \u00e9galement permis au SCRS de demander un <a href=\"https:\/\/dev.ccla.org\/natsecglossary\/\" target=\"_blank\" rel=\"noopener\">mandat<\/a> devant les tribunaux leur permettant de violer les droits <i>de la Charte<\/i> . La CCLA a identifi\u00e9 ces mandats de violation <i>de la Charte<\/i> comme un probl\u00e8me majeur dans notre contestation du C-51 \u2014 lors d\u2019un processus normal de mandat, le r\u00f4le d\u2019un juge est de s\u2019assurer que les actions gouvernementales respectent, et non qu\u2019elles violent <i>, la<\/i> Charte.   <\/p>\n<p>D\u00e9cevant, le C-59 ne supprime pas ces nouveaux pouvoirs, mais il apporte une certaine clart\u00e9 sur ce que le SCRS ne peut pas faire de son propre chef, ainsi que sur ce qu\u2019il peut faire avec une autorisation judiciaire. Le SCRS est d\u00e9sormais express\u00e9ment interdit de pratiquer la torture (ce qu\u2019il \u00e9tait d\u00e9j\u00e0 interdit selon le droit international), de d\u00e9tenir quiconque et de mettre en danger la s\u00e9curit\u00e9 d\u2019un individu en causant la perte ou la destruction grave de biens. <\/p>\n<p>De plus, le SCRS est interdit d\u2019entreprendre toute action de sa propre initiative qui imposerait une limite \u00e0 un droit prot\u00e9g\u00e9 par la <i>Charte<\/i>. Bien que ces interdictions soient raisonnables, elles laissent beaucoup de place au SCRS pour agir de mani\u00e8re portant atteinte aux droits. Le SCRS peut-il se faire passer pour un journaliste afin de gagner en cr\u00e9dibilit\u00e9 aupr\u00e8s d\u2019une cible? Peuvent-ils flatter un profil en ligne pour miner la r\u00e9putation d\u2019une personne? Probablement, puisque de telles choses ne sont pas clairement interdites par des exceptions dans le projet C-59, et elles ne seraient pas non plus clairement consid\u00e9r\u00e9es comme une violation de <i>la Charte<\/i> . Le SCRS peut faire <i>encore plus<\/i> s\u2019il convainc un juge qu\u2019une activit\u00e9 particuli\u00e8re est raisonnable, proportionn\u00e9e, conforme <i>\u00e0 la Charte<\/i> et n\u00e9cessaire pour r\u00e9duire une menace \u00e0 la s\u00e9curit\u00e9. Le projet de loi C-51 laissait la liste des activit\u00e9s possibles pouvant \u00eatre entreprises avec l\u2019approbation judiciaire ouverte \u00e0 l\u2019imagination des agents du SCRS cherchant \u00e0 les r\u00e9aliser. Le projet de loi C-59, en revanche, tente de limiter cette ouverture en fournissant une liste pr\u00e9cise de mesures de perturbation des menaces, mais la nouvelle liste demeure assez large et pourrait m\u00eame inclure des activit\u00e9s probl\u00e9matiques comme la perturbation d\u2019une \u00e9lection \u00e9trang\u00e8re. Ces demandes de mandat du SCRS se font toutes en secret, sans processus conflictuel et sans examen public.        <\/p>\n<p>Lorsque ces pouvoirs ont \u00e9t\u00e9 introduits dans le projet de loi C-51, il n\u2019y a jamais eu de justification publique significative de la part du gouvernement quant \u00e0 leur n\u00e9cessit\u00e9. Le C-59 offre une occasion importante au public de discuter de la question de savoir si nous pensons que notre agence de renseignement a r\u00e9ellement besoin de ces pouvoirs, et pour que le gouvernement explique pourquoi il estime que les pouvoirs de perturbation sont n\u00e9cessaires et proportionn\u00e9s. <\/p>\n<p><strong><a href=\"\/?p=27988\">VISITEZ NOTRE PROJET DE LOI C-59 : FAITES-LE BIEN!
