width=\u00a0\u00bb1\/1&Prime; tablet_width_inherit=\u00a0\u00bbdefault\u00a0\u00bb tablet_text_alignment=\u00a0\u00bbdefault\u00a0\u00bb phone_text_alignment=\u00a0\u00bbdefault\u00a0\u00bb bg_image_animation=\u00a0\u00bbnone\u00a0\u00bb border_type=\u00a0\u00bbsimple\u00a0\u00bb column_border_width=\u00a0\u00bbnone\u00a0\u00bb column_border_style=\u00a0\u00bbsolid\u00a0\u00bb][divider line_type=\u00a0\u00bbNo Line\u00a0\u00bb custom_height=\u00a0\u00bb30&Prime;][vc_column_text]\n<div class=\"entry-meta\">\n<p><span class=\"posted-on\"><time class=\"entry-date published\" datetime=\"2016-06-20T14:22:06-04:00\">20 juin 2016<\/time><\/span><\/p>\n<\/div>\n<div class=\"shapely-content \">\n<p class=\"p1\"><span class=\"s1\">La CCLA appuie l\u2019introduction du <strong><a href=\"http:\/\/www.parl.gc.ca\/HousePublications\/Publication.aspx?Language=E&amp;Mode=1&amp;DocId=8375614\" target=\"_blank\" rel=\"noopener\">projet de loi C-22<\/a><\/strong>, qui cr\u00e9e un Comit\u00e9 de parlementaires sur la s\u00e9curit\u00e9 nationale et le renseignement avec la capacit\u00e9 de surveiller les activit\u00e9s de s\u00e9curit\u00e9 et de renseignement classifi\u00e9es et de faire rapport aux conclusions du premier ministre.  <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Ce nouveau m\u00e9canisme de reddition de comptes est crucial parce qu\u2019\u00e0 ce jour, il n\u2019y a pas eu de responsabilit\u00e9 proportionnelle accompagnant les larges pouvoirs des \u00c9tats introduits par le projet de loi C-51. Nous notons \u00e9galement que le Comit\u00e9 aura le pouvoir de surveiller les actions de l\u2019Agence des services frontaliers du Canada (ASFC). Contrairement \u00e0 la GRC, au SCRS et au CST, l\u2019ASFC n\u2019a jusqu\u2019\u00e0 pr\u00e9sent fait l\u2019objet d\u2019aucune surveillance, malgr\u00e9 le fait que 14 personnes sont d\u00e9c\u00e9d\u00e9es sous sa garde (et celle de ses agences pr\u00e9d\u00e9cesseures).    <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Cependant, nous croyons que des parties cl\u00e9s du projet de loi C-22 doivent \u00eatre examin\u00e9es avec soin et possiblement modifi\u00e9es. Premi\u00e8rement, nous sommes pr\u00e9occup\u00e9s par le pouvoir du gouvernement d\u2019arr\u00eater une enqu\u00eate du Comit\u00e9, ou de refuser de fournir des informations, lorsqu\u2019elles sont jug\u00e9es \u00ab nuisibles \u00e0 la s\u00e9curit\u00e9 nationale \u00bb. Bien que nous reconnaissions que le plus grand secret est parfois n\u00e9cessaire, cela est particuli\u00e8rement pr\u00e9occupant car ces d\u00e9cisions sont finales et ne sont pas soumises \u00e0 un contr\u00f4le judiciaire ni \u00e0 un autre processus de r\u00e9solution des diff\u00e9rends. Autre inqui\u00e9tude est le pouvoir du premier ministre de caviarder les rapports du Comit\u00e9 (sans aucune preuve que des caviardages aient \u00e9t\u00e9 faits), ainsi que les nombreuses cat\u00e9gories d\u2019informations auxquelles le comit\u00e9 ne peut pas avoir acc\u00e8s. De plus, ce devraient \u00eatre les membres du Comit\u00e9 eux-m\u00eames \u2014 et non le premier ministre \u2014 qui choisissent le pr\u00e9sident du Comit\u00e9.      <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Par-dessus tout, il est important de noter que ce m\u00e9canisme seul \u2014 ainsi que d\u2019autres promesses du programme \u00e9lectoral du Parti lib\u00e9ral \u2014 n\u2019annule pas compl\u00e8tement les dommages caus\u00e9s par le projet de loi C-51. Notamment, il n\u2019y a toujours pas d\u2019intention d\u00e9clar\u00e9e d\u2019\u00e9liminer les nouveaux pouvoirs \u00e9tendus du gouvernement sur le partage d\u2019informations, ni les changements pr\u00e9occupants apport\u00e9s \u00e0 la <i>Loi sur l\u2019immigration et la protection des r\u00e9fugi\u00e9s \u2014 <\/i>deux mesures que nous contestons devant les tribunaux.   <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Des m\u00e9canismes de reddition de comptes robustes et significatifs sont essentiels pour les agences de s\u00e9curit\u00e9 et de renseignement. Sans de tels m\u00e9canismes, ces agences pourraient porter atteinte aux droits et libert\u00e9s des individus au Canada, entra\u00eenant de graves violations des droits et mena\u00e7ant simultan\u00e9ment les fondements tr\u00e8s d\u00e9mocratiques du Canada. La CCLA s\u2019est battue pour la responsabilit\u00e9 en mati\u00e8re de s\u00e9curit\u00e9 nationale dans <strong><a href=\"https:\/\/dev.ccla.org\/wp-content\/uploads\/2021\/06\/CCLA-Senate-Committee-20-04-15.pdf\" target=\"_blank\" rel=\"noopener\">des soumissions \u00e9crites au Comit\u00e9 s\u00e9natorial de la s\u00e9curit\u00e9 et de la d\u00e9fense nationales<\/a><\/strong>,<strong> <\/strong><\/span><span class=\"s1\">ainsi que dans notre <strong><a href=\"https:\/\/dev.ccla.org\/wp-content\/uploads\/2021\/06\/Issued-Notice-of-Application-Bill-C-51-C1383715xA0E3A-1.pdf\" target=\"_blank\" rel=\"noopener\">contestation de la Charte contre le projet de loi C-51<\/a><\/strong>.
