Le projet de loi 175, tel que modifi\u00e9 par le comit\u00e9 et adopt\u00e9 en troisi\u00e8me lecture, peut \u00eatre <a href=\"http:\/\/www.ontla.on.ca\/bills\/bills-files\/41_Parliament\/Session2\/b175rep_e.pdf\" target=\"_blank\" rel=\"noopener\">consult\u00e9 ici<\/a>.<\/p><\/blockquote>\n<p>Hier, le gouvernement provincial de l\u2019Ontario a conclu ses audiences en comit\u00e9 sur la <em>Loi pour un Ontario plus s\u00e9curitaire<\/em>, une l\u00e9gislation qui apporterait des changements importants au syst\u00e8me de surveillance et de reddition de comptes polici\u00e8re de l\u2019Ontario. La CCLA a comparu devant le Comit\u00e9 pour recommander plusieurs amendements n\u00e9cessaires \u00e0 la l\u00e9gislation propos\u00e9e. <\/p>\n<p>L\u2019Association canadienne des libert\u00e9s civiles milite depuis longtemps pour une r\u00e9forme de la police en Ontario. Depuis des d\u00e9cennies, la police dans la province a \u00e9t\u00e9 min\u00e9e par des d\u00e9ficits de reddition de comptes, de surveillance et de transparence. Une refonte l\u00e9gislative de la d\u00e9su\u00e8te <em>Loi sur les services policiers<\/em> de l\u2019Ontario est n\u00e9cessaire pour commencer \u00e0 combler ces d\u00e9ficits.  <\/p>\n<p>La <em>Loi pour un Ontario plus s\u00fbr<\/em> vise principalement \u00e0 renforcer la responsabilit\u00e9, la surveillance et la transparence en Ontario en mettant en \u0153uvre la majorit\u00e9 des recommandations du juge Tulloch dans son <a href=\"https:\/\/www.attorneygeneral.jus.gov.on.ca\/english\/about\/pubs\/police_oversight_review\/\" target=\"_blank\" rel=\"noopener\"><em>rapport sur l\u2019examen ind\u00e9pendant de la surveillance polici\u00e8re<\/em><\/a>. Cependant, les recommandations du juge Tulloch sont issues de consultations publiques qui ont r\u00e9v\u00e9l\u00e9 des niveaux alarmants de m\u00e9fiance envers les services policiers de l\u2019Ontario et leurs organismes de surveillance et de responsabilit\u00e9, y compris une pr\u00e9occupation g\u00e9n\u00e9ralis\u00e9e concernant la discrimination syst\u00e9mique dans la police ontarienne. Bien que plusieurs des r\u00e9formes <em>propos\u00e9es par la Loi pour un Ontario plus s\u00fbr<\/em> pourraient aider \u00e0 s\u2019attaquer \u00e0 ce probl\u00e8me omnipr\u00e9sent de m\u00e9fiance, des efforts substantiels seront n\u00e9cessaires pour s\u2019assurer que tout nouvel organisme de surveillance et de reddition de comptes soit v\u00e9ritablement ind\u00e9pendant des services policiers qu\u2019ils supervisent. Des efforts substantiels seront \u00e9galement n\u00e9cessaires pour s\u2019assurer que tout nouvel organisme de surveillance et de reddition de comptes soit ad\u00e9quatement financ\u00e9 et pr\u00eat \u00e0 utiliser les pouvoirs qui pourraient leur \u00eatre attribu\u00e9s.   <\/p>\n<p>La principale de nos recommandations est que la l\u00e9gislation propos\u00e9e par le gouvernement soit modifi\u00e9e afin d\u2019accorder des pouvoirs plus robustes aux autorit\u00e9s civiles charg\u00e9es de superviser les services policiers. Les fonctionnaires publics et les conseils de surveillance doivent jouer un r\u00f4le actif et inform\u00e9 sur les questions ayant un impact significatif sur les droits prot\u00e9g\u00e9s par <em>la Charte<\/em> et le Code des r\u00e9sidents en vertu de la Charte et du <em>Code<\/em>, comme la pratique du carding ou la question g\u00e9n\u00e9rale du profilage racial ou social. Comme nous le soutenons dans nos soumissions, les autorit\u00e9s civiles sont souvent inutilement entrav\u00e9es dans leurs obligations de surveillance et de reddition de comptes par les services policiers, qui soutiennent que tenter de r\u00e9gler ces questions constituerait une atteinte \u00e0 leur ind\u00e9pendance op\u00e9rationnelle.
