Je sais qu&#039;il y a beaucoup de choses que fait ce projet de loi, mais mes remarques aujourd&#039;hui se limitent \u00e0 la question des changements aux r\u00e8gles pour les tiers.<\/p>\n<p>Je suis d\u00e9sol\u00e9 de le dire, mais pour le fait que cette r\u00e9union se fasse par vid\u00e9oconf\u00e9rence, aujourd&#039;hui, c&#039;est encore une fois un d\u00e9j\u00e0 vu.<\/p>\n<p>J&#039;ai comparu devant le Comit\u00e9 permanent du gouvernement g\u00e9n\u00e9ral au nom de l&#039;ACLC, il y a un peu moins de cinq ans, pour commenter un envoi d&#039;amendements \u00e0 la Loi sur le financement des \u00e9lections propos\u00e9 par le dernier gouvernement.<\/p>\n<p>\u00c0 ce moment-l\u00e0, j&#039;ai expos\u00e9 les pr\u00e9occupations de l&#039;ACLC concernant le r\u00e9gime de publicit\u00e9 par des tiers qui a \u00e9t\u00e9 propos\u00e9, en mettant l&#039;accent en particulier sur l&#039;\u00e9tendue de la d\u00e9finition de la Loi de la publicit\u00e9 politique et la dur\u00e9e de la p\u00e9riode pr\u00e9alable au bref pendant laquelle la publicit\u00e9 est r\u00e9glement\u00e9e (six mois). Je tiens \u00e0 pr\u00e9ciser que l&#039;ACLC ne s&#039;oppose pas \u00e0 l&#039;imposition de certaines limites aux activit\u00e9s des tiers pendant la p\u00e9riode \u00e9lectorale et comprend qu&#039;avec des \u00e9lections \u00e0 date fixe, une certaine r\u00e9glementation dans une p\u00e9riode pr\u00e9-\u00e9lectorale peut \u00e9galement aider \u00e0 atteindre des objectifs valables. En particulier, nous reconnaissons la n\u00e9cessit\u00e9 de limiter la mesure dans laquelle ceux qui disposent de plus de ressources financi\u00e8res sont en mesure de fa\u00e7onner les r\u00e9sultats \u00e9lectoraux. Il y a un \u00e9quilibre prudent qui doit \u00eatre atteint entre assurer une solide protection de l&#039;expression politique et l&#039;\u00e9quit\u00e9 \u00e9lectorale. Nous estimons que le r\u00e9gime actuel de la Loi sur le financement des \u00e9lections n&#039;atteint pas le bon \u00e9quilibre et croyons que les changements propos\u00e9s dans le projet de loi 254 nous \u00e9loigneront davantage. En effet, \u00e0 notre avis, ces changements restreignent d\u00e9raisonnablement la libert\u00e9 d&#039;expression prot\u00e9g\u00e9e par la Charte d&#039;une mani\u00e8re qui n&#039;est pas manifestement justifi\u00e9e.<\/p>\n<p>La publicit\u00e9 de tiers est un discours politique, qui est au c\u0153ur m\u00eame de la protection de la libert\u00e9 d&#039;expression. La p\u00e9riode actuelle de six mois de pr\u00e9-\u00e9lectorat est d\u00e9j\u00e0 longue et donne lieu \u00e0 un risque tr\u00e8s r\u00e9el de refroidir le discours politique qui consiste plus \u00e0 d\u00e9battre du bien-fond\u00e9 des choix politiques qu&#039;\u00e0 persuader ou manipuler les \u00e9lecteurs. En effet, restreindre le discours politique dans les six mois pr\u00e9c\u00e9dant le d\u00e9clenchement d&#039;une \u00e9lection est une mesure extraordinaire qui n&#039;est reproduite dans aucune autre juridiction canadienne. Une p\u00e9riode ant\u00e9rieure au bref plus courte a \u00e9t\u00e9 d\u00e9clar\u00e9e inconstitutionnelle \u00e0 deux reprises par les tribunaux de la Colombie-Britannique et, sans surprise, le r\u00e9gime ontarien fait l&#039;objet d&#039;une contestation constitutionnelle qui est actuellement devant les tribunaux.<\/p>\n<p>Nonobstant le litige en cours, le gouvernement a maintenant d\u00e9cid\u00e9 d&#039;aller de l&#039;avant avec des changements qui maintiendraient les r\u00e9glementations restrictives en place deux fois plus longtemps \u2013 un discours effrayant en troisi\u00e8me partie non seulement six mois avant l&#039;annulation d&#039;un bref, mais pendant une ann\u00e9e compl\u00e8te avant. De plus, alors que le temps pendant lequel le discours politique est r\u00e9glement\u00e9 a doubl\u00e9, les montants en dollars que les tiers sont limit\u00e9s \u00e0 d\u00e9penser n&#039;ont pas chang\u00e9. Je ferai remarquer qu&#039;il n&#039;y a aucune proposition visant \u00e0 allonger la p\u00e9riode pendant laquelle la publicit\u00e9 politique est restreinte pour les partis politiques en vertu de l&#039;article 38.1 de la Loi.<\/p>\n<p>Lorsque le procureur g\u00e9n\u00e9ral a pr\u00e9sent\u00e9 ces changements \u00e0 l&#039;Assembl\u00e9e, il les a pr\u00e9sent\u00e9s comme donnant la priorit\u00e9 aux gens, d\u00e9clarant\u00a0: \u00ab\u00a0Nous croyons fermement que les \u00e9lecteurs de l&#039;Ontario devraient d\u00e9terminer le r\u00e9sultat des \u00e9lections, et non les organisations \u00e9ph\u00e9m\u00e8res, les conglom\u00e9rats \u00e0 gros revenus ou les groupes d&#039;action politique anonymes. . &quot; Avec tout le respect que je dois au procureur g\u00e9n\u00e9ral, les \u00e9lecteurs d\u00e9terminent le r\u00e9sultat des \u00e9lections en votant, et pour ce faire, ils doivent \u00eatre bien inform\u00e9s. Les tiers r\u00e9gis par la Loi peuvent avoir des structures juridiques particuli\u00e8res (syndicats, corporations, associations) mais, au fond, ils sont constitu\u00e9s d&#039;\u00e9lecteurs ontariens. Les r\u00e8gles relatives aux tiers restreignent non seulement le type de d\u00e9bats auxquels ils peuvent participer pendant une ann\u00e9e compl\u00e8te avant une \u00e9lection, elles restreignent \u00e9galement l&#039;information et les perspectives que les \u00e9lecteurs de l&#039;Ontario sont autoris\u00e9s \u00e0 entendre pour aider \u00e0 \u00e9clairer leur vote lorsque les \u00e9lections auront lieu. Plut\u00f4t que de donner la priorit\u00e9 aux gens, les modifications apport\u00e9es aux r\u00e8gles de publicit\u00e9 des tiers visent simplement \u00e0 enraciner le monopole que les partis politiques et les candidats ont sur le d\u00e9bat et la discussion sur les questions \u00e9lectorales.<\/p>\n<p>Je veux aborder bri\u00e8vement l&#039;\u00e9tendue de la d\u00e9finition de \u00ab publicit\u00e9 politique \u00bb dans la Loi. Cela comprend non seulement la publicit\u00e9 dans le but de promouvoir ou de s&#039;opposer \u00e0 des candidats ou des partis, mais aussi des communications qui prennent position sur une question qui \u00ab peut raisonnablement \u00eatre consid\u00e9r\u00e9e comme \u00e9troitement associ\u00e9e \u00e0 un parti enregistr\u00e9 ou \u00e0 son chef ou \u00e0 un candidat enregistr\u00e9 \u00bb. En Ontario, nos prochaines \u00e9lections auront lieu au plus tard le 2 juin 2022. Si les modifications contenues dans le projet de loi 254 sont adopt\u00e9es, les actions des tiers seront restreintes \u00e0 compter de cet \u00e9t\u00e9. Il est peut-\u00eatre trop t\u00f4t pour savoir quels probl\u00e8mes sont ou seront associ\u00e9s aux partis ou aux candidats (ce qui donne lieu \u00e0 des difficult\u00e9s d&#039;application potentielles pour \u00c9lections Ontario), mais il va de soi que la gestion de la pand\u00e9mie, les foyers de soins de longue dur\u00e9e, l&#039;accessibilit\u00e9 aux vaccins et la pr\u00e9paration aux situations d&#039;urgence sont toutes susceptibles d&#039;\u00eatre des questions pertinentes lors des prochaines \u00e9lections. Ceux-ci sont susceptibles d&#039;\u00eatre associ\u00e9s non seulement \u00e0 un seul parti ou candidat, mais tr\u00e8s probablement \u00e0 plusieurs. Que le gouvernement limite consid\u00e9rablement l&#039;expression sur ces sujets pendant une ann\u00e9e compl\u00e8te avant les \u00e9lections n&#039;est pas, \u00e0 notre avis, justifiable.
