Cela signifie que les fruits d\u2019une fouille ne peuvent pas \u00eatre utilis\u00e9s pour justifier une violation d\u00e9raisonnable de la vie priv\u00e9e. Cet argument a \u00e9t\u00e9 central dans l\u2019intervention de la CCLA devant la Cour supr\u00eame du Canada (SCC) dans <\/span><em>l\u2019affaire York Region District School Board c. F\u00e9d\u00e9ration des enseignants du primaire de l\u2019Ontario<\/em><span data-contrast=\"auto\">.<\/span><\/em><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Plus t\u00f4t aujourd\u2019hui, la SCC a confirm\u00e9 que les enseignants des conseils scolaires publics de l\u2019Ontario sont prot\u00e9g\u00e9s par l\u2019article 8 de la   <\/span><em>Charter<\/em> <span data-contrast=\"auto\">au travail. La d\u00e9cision majoritaire a \u00e9galement statu\u00e9 que l\u2019\u00e9valuation de l\u2019existence d\u2019une attente raisonnable de vie priv\u00e9e au moment de la recherche devait \u00eatre neutre en mati\u00e8re de contenu. La d\u00e9cision minoritaire a approfondi cette conclusion, expliquant que l\u2019\u00e9valuation de l\u2019attente raisonnable en mati\u00e8re de vie priv\u00e9e des enseignants ne d\u00e9pendait pas de ce qui avait r\u00e9ellement <\/span> <em><span data-contrast=\"auto\"> \u00e9t\u00e9 constat\u00e9. Ce qui comptait, c\u2019\u00e9tait la <\/span> <em>possibilit\u00e9<\/em><span data-contrast=\"auto\"> que la recherche r\u00e9v\u00e8le des informations touchant au noyau biographique des enseignants. Cela est conforme aux arguments pr\u00e9sent\u00e9s par la CCLA en tant qu\u2019intervenante dans cette affaire. Sinon, les acteurs gouvernementaux comme les conseils scolaires seraient encourag\u00e9s \u00e0 lire un registre ou une conversation avant de se demander ce qu\u2019ils doivent faire pour respecter les droits \u00e0 la vie priv\u00e9e de leurs employ\u00e9s.<\/span><\/em>  <span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">La d\u00e9cision minoritaire a \u00e9galement fait \u00e9cho aux arguments de la CCLA sur la n\u00e9cessit\u00e9 d\u2019adopter une approche large et flexible de ce qui constitue une communication priv\u00e9e afin de suivre les avanc\u00e9es technologiques et les nouvelles formes de communication. La d\u00e9cision minoritaire a statu\u00e9 que l\u2019information contenue sur les appareils connect\u00e9s \u00e0 Internet tend normativement \u00e0 r\u00e9v\u00e9ler les int\u00e9r\u00eats, les go\u00fbts et les penchants sp\u00e9cifiques d\u2019une personne, et qu\u2019elle est donc au c\u0153ur m\u00eame du noyau biographique prot\u00e9g\u00e9 par s.  8. La majorit\u00e9 n\u2019a pas abord\u00e9 directement cette question.<\/span><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Cet appel fait suite \u00e0 une d\u00e9cision de la Cour d\u2019appel de l\u2019Ontario qui a statu\u00e9 qu\u2019un directeur du conseil scolaire du district de la r\u00e9gion de York (le conseil) a effectu\u00e9 une fouille et une saisie ill\u00e9gales de l\u2019ordinateur portable d\u2019un enseignant lorsqu\u2019il a acc\u00e9d\u00e9, lu et captur\u00e9 des captures d\u2019\u00e9cran des communications priv\u00e9es de deux enseignants. Les captures d\u2019\u00e9cran de ces communications enregistr\u00e9es sur leur journal personnel prot\u00e9g\u00e9 par mot de passe stock\u00e9 dans le Cloud ont \u00e9t\u00e9 utilis\u00e9es dans des proc\u00e9dures disciplinaires contre les deux enseignants. Le syndicat a d\u00e9pos\u00e9 une plainte pour violation du droit \u00e0 la vie priv\u00e9e des enseignants par le conseil. L\u2019arbitre a rejet\u00e9 le grief, et la majorit\u00e9 de la Cour divisionnaire a confirm\u00e9 cette d\u00e9cision et rejet\u00e9 la demande de contr\u00f4le judiciaire.   <\/span><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">La CCLA accueille favorablement le renforcement par le SCC des principes bien \u00e9tablis de l\u2019article 8. Parce que ces principes sont fondamentaux \u00e0 notre fa\u00e7on de concevoir la vie priv\u00e9e en vertu de l\u2019article 8, leurs impacts se feront sentir au-del\u00e0 du contexte des conseils scolaires et plus largement dans tout cas portant atteinte aux droits \u00e0 la vie priv\u00e9e en vertu de l\u2019article 8 de la <\/span><em>Charte<\/em><span data-contrast=\"auto\">.<\/span><span
