La CCLA a avanc\u00e9 cet argument dans des soumissions \u00e0 la r\u00e9cente \u00e9tude sur la technologie de reconnaissance faciale (FRT) men\u00e9e par le Comit\u00e9 permanent sur l\u2019acc\u00e8s \u00e0 l\u2019information, la vie priv\u00e9e et l\u2019\u00e9thique (ETHI). Nous sommes tout \u00e0 fait d\u2019accord avec les conclusions du Comit\u00e9 dans leur rapport publi\u00e9 le 4 octobre 2022 :  <\/span><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">L\u2019\u00e9tude du Comit\u00e9 a confirm\u00e9 que le cadre l\u00e9gislatif actuel du Canada ne r\u00e9glemente pas ad\u00e9quatement la TRF et l\u2019IA. Sans un cadre appropri\u00e9, le FRT et d\u2019autres outils d\u2019IA pourraient causer des dommages irr\u00e9parables \u00e0 certaines personnes. <\/span><span data-ccp-props=\"{\"335559685\":720}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Le Comit\u00e9 estime donc que, lorsque la RFT ou d\u2019autres technologies d\u2019IA sont utilis\u00e9es, elles doivent \u00eatre utilis\u00e9es de mani\u00e8re responsable, dans un cadre l\u00e9gislatif solide qui prot\u00e8ge les droits \u00e0 la vie priv\u00e9e et les libert\u00e9s civiles des Canadiens. Puisqu\u2019un tel cadre l\u00e9gislatif n\u2019existait pas \u00e0 l\u2019\u00e9poque, une pause nationale devrait \u00eatre impos\u00e9e \u00e0 l\u2019utilisation de la TVR, particuli\u00e8rement en ce qui concerne les services policiers. <\/span><span data-ccp-props=\"{\"335559685\":720}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Le Comit\u00e9 formule 19 recommandations g\u00e9n\u00e9ralement solides. Les points saillants incluent des recommandations interdisant l\u2019obtention d\u2019informations personnelles obtenues ill\u00e9galement et l\u2019obligation de faire un rapport public lorsque la RFT ou d\u2019autres outils algorithmiques, y compris des essais gratuits, sont acquis par des institutions gouvernementales. Ces recommandations aideraient \u00e0 pr\u00e9venir un futur scandale comme celui cr\u00e9\u00e9 lorsque la GRC a secr\u00e8tement utilis\u00e9 le logiciel d\u2019IA Clearview, une <\/span><a href=\"https:\/\/www.priv.gc.ca\/en\/opc-news\/news-and-announcements\/2021\/nr-c_210610\/\"><span data-contrast=\"none\">enqu\u00eate conjointe<\/span><\/a> des commissaires \u00e0 la protection de la vie priv\u00e9e jug\u00e9e <span data-contrast=\"auto\"> ill\u00e9gale selon la loi canadienne.<\/span><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">D\u2019autres recommandations cl\u00e9s visent la reddition de comptes et la transparence incluent la cr\u00e9ation d\u2019un registre public d\u2019IA des outils utilis\u00e9s par les entit\u00e9s op\u00e9rant au Canada, l\u2019augmentation de l\u2019engagement des parties prenantes de la soci\u00e9t\u00e9 civile dans les processus existants d\u2019\u00e9valuation de l\u2019impact de l\u2019IA, et l\u2019\u00e9tablissement de \u00ab mesures politiques robustes au sein du secteur public pour l\u2019utilisation de la technologie de reconnaissance faciale qui pourraient \u00bb [nous dirions devraient] \u00ab inclure un avis public imm\u00e9diat et anticip\u00e9 ainsi que des commentaires publics,  la consultation avec des groupes marginalis\u00e9s et des m\u00e9canismes de surveillance ind\u00e9pendants. \u00bb<\/span><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Pour s\u2019attaquer aux risques bien connus de biais et d\u2019impacts discriminatoires des syst\u00e8mes FRT, des recommandations demandent au gouvernement d\u2019investir dans l\u2019\u00e9tude de l\u2019impact de l\u2019intelligence artificielle sur diff\u00e9rents groupes, et d\u2019assurer \u00ab une divulgation compl\u00e8te et transparente des biais raciaux, d\u2019\u00e2ge ou inconscients qui pourraient exister dans la technologie de reconnaissance faciale utilis\u00e9e par le gouvernement,  d\u00e8s que le biais est d\u00e9tect\u00e9 dans le contexte de sc\u00e9narios de test ou d\u2019applications r\u00e9elles de la technologie, sous r\u00e9serve de pr\u00e9occupations de s\u00e9curit\u00e9 nationale. \u00bb Bien s\u00fbr, l\u2019exclusion de la s\u00e9curit\u00e9 nationale pose probl\u00e8me, \u00e9tant donn\u00e9 que les risques de discrimination sont particuli\u00e8rement \u00e9lev\u00e9s dans des contextes comme la s\u00e9curit\u00e9 des fronti\u00e8res. <\/span><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Il existe une s\u00e9rie de recommandations concernant la n\u00e9cessit\u00e9 de l\u00e9gif\u00e9rer des protections, notamment :<\/span><span data-ccp-props=\"{}\"> technologies algorithmiques et interdire d\u2019autres usages, y compris la surveillance de masse;<\/span><span data-ccp-props=\"{}\"> <\/span><\/li>\n<li data-leveltext=\"\uf0b7\" la protection de la vie<\/span> <span data-contrast=\"auto\">priv\u00e9e et d\u00e9posent des \u00e9valuations d\u2019impact sur la vie priv\u00e9e;<\/span><span biom\u00e9triques par les entit\u00e9s du secteur priv\u00e9 et l\u2019interdiction de ces entit\u00e9s d\u2019exiger une biom\u00e9trie comme condition de service;<\/span><span data-ccp-props=\"{}\"> <\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"1\" data-list-defn-props=\"{\"335552541\":1,\"335559684\":-2,\"335559685\":720,\"335559991\":360,\"469769226\":\"Symbol\",\"469769242\":[8226],\"469777803\":\"left\",\"469777804\":\"\uf0b7\",\"469777815\":\"hybridMultilevel\"}\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><span data-contrast=\"auto\">Renforcer la capacit\u00e9 du commissaire \u00e0 la protection de la vie priv\u00e9e \u00e0 imposer des sanctions significatives en cas de violation de la loi.<\/span><span data-ccp-props=\"{}\"> <\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"1\" data-list-defn-props=\"{\"335552541\":1,\"335559684\":-2,\"335559685\":720,\"335559991\":360,\"469769226\":\"Symbol\",\"469769242\":[8226],\"469777803\":\"left\",\"469777804\":\"\uf0b7\",\"469777815\":\"hybridMultilevel\"}\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><span data-contrast=\"auto\">\u00c9laboration d\u2019un cadre r\u00e9glementaire concernant les usages, interdictions, surveillance et confidentialit\u00e9 des technologies de reconnaissance faciale, incluant des mesures de surveillance proactives.<\/span><span data-ccp-props=\"{}\"> <\/span><\/li>\n<\/ul>\n<p><span data-contrast=\"auto\">Enfin, l\u2019une des recommandations les plus importantes concerne la n\u00e9cessit\u00e9 de prot\u00e9ger les photos de personnes, qu\u2019elles soient en ligne ou prises dans des espaces publics, contre la collecte non consentie pour une utilisation dans les syst\u00e8mes d\u2019IA. La recommandation 17 stipule : <\/span><span data-ccp-props=\"{}\"> <\/span><span data-contrast=\"auto\">Que le gouvernement du Canada modifie la Loi sur la protection de la vie priv\u00e9e et la loi personnelle<\/span><span data-ccp-props=\"{\"335559685\":720}\"> <\/span><span data-contrast=\"auto\">Loi sur la protection de l\u2019information et les documents \u00e9lectroniques interdisant la pratique de capturer des images de Canadiens provenant d\u2019Internet ou d\u2019espaces publics pour le<\/span><span data-ccp-props=\"{\"335559685\":720}\"> <\/span><span data-contrast=\"auto\">Objectif de peupler la technologie de reconnaissance faciale, les bases de donn\u00e9es ou les logiciels artificiels<\/span><span data-ccp-props=\"{\"335559685\":720}\"> <\/span><span data-contrast=\"auto\">algorithmes d\u2019intelligence.<\/span><span data-ccp-props=\"{\"335559685\":720}\"> <\/span><span data-ccp-props=\"{\"335559685\":720}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Le Comit\u00e9 ETHI a fait un bon travail pour synth\u00e9tiser et refl\u00e9ter les pr\u00e9occupations des t\u00e9moins qui ont comparu devant lui et a propos\u00e9 des recommandations qui contribueraient grandement \u00e0 prot\u00e9ger les populations \u00e0 travers le Canada contre les usages portant atteinte aux droits de la TRV et d\u2019autres technologies aliment\u00e9es par l\u2019IA. C\u2019est maintenant au gouvernement de prendre en compte les recommandations. Le rapport arrive \u00e0 l\u2019opportunit\u00e9, avec le nouveau projet de loi sur la vie priv\u00e9e C-27 qui avance vers le comit\u00e9. Des amendements \u00e0 ce projet de loi pourraient et devraient \u00eatre apport\u00e9s en r\u00e9ponse \u00e0 certaines de ces recommandations, et les r\u00e9formes de la Loi sur la protection de la vie priv\u00e9e sont \u00e9galement indiqu\u00e9es. En attendant cette l\u00e9gislation, le moratoire sur les services policiers f\u00e9d\u00e9raux et l\u2019utilisation du FRT par les industries canadiennes, recommand\u00e9 par l\u2019ETHI et appuy\u00e9 par un large \u00e9ventail de t\u00e9moins, y compris la CCLA, devrait \u00eatre convoqu\u00e9 imm\u00e9diatement.
