UR Pride Centre for Sexuality and Gender Diversity<\/em>, une affaire historique port\u00e9e devant la Cour supr\u00eame du Canada qui d\u00e9terminera si les tribunaux conservent la comp\u00e9tence de d\u00e9clarer <em>chartes<\/em> les violations des droits qui surviennent lorsqu'un gouvernement passe outre aux droits et libert\u00e9s fondamentaux en recourant \u00e0 la clause d\u00e9rogatoire.<\/p>\n<p>Cette affaire trouve son origine dans la loi adopt\u00e9e en 2023 par la Saskatchewan, qui exige le consentement parental avant que le personnel scolaire puisse utiliser le pr\u00e9nom ou les pronoms de pr\u00e9dilection d\u2019un \u00e9l\u00e8ve de moins de 16 ans \u00e0 l\u2019\u00e9cole. L\u2019UR Pride Centre for Sexuality and Gender Diversity a contest\u00e9 cette loi, estimant qu\u2019elle constituait une violation des droits des \u00e9l\u00e8ves\u2019 <em>chartes<\/em> droits. En r\u00e9ponse, le gouvernement de la Saskatchewan a invoqu\u00e9 la clause d\u00e9rogatoire et a fait valoir que cette mesure permettait non seulement d\u2019emp\u00eacher l\u2019annulation de la loi, mais aussi de priver les tribunaux de la comp\u00e9tence n\u00e9cessaire pour d\u00e9terminer si cette loi violait les droits garantis par la Charte. La Cour d\u2019appel de la Saskatchewan a rejet\u00e9 cette position, affirmant que les tribunaux pouvaient toujours d\u00e9clarer des violations de la Charte. Le gouvernement de la Saskatchewan a d\u00e9sormais interjet\u00e9 appel de cette d\u00e9cision devant la Cour supr\u00eame du Canada.<\/p>\n<p>La CCLA interviendra dans cette affaire afin d\u2019\u00e9tablir un cadre de r\u00e9f\u00e9rence fond\u00e9 sur des principes permettant de comprendre la port\u00e9e et les limites appropri\u00e9es de la clause d\u00e9rogatoire dans l\u2019ordre constitutionnel canadien. La CCLA fera valoir que l\u2019article 33 n\u2019emp\u00eache pas les tribunaux de se prononcer sur les questions relatives aux droits constitutionnels. Bien que la clause d\u00e9rogatoire puisse permettre aux gouvernements de passer temporairement outre \u00e0 certaines <em>chartes <\/em>Ces protections n\u2019emp\u00eachent toutefois pas le pouvoir judiciaire de remplir son r\u00f4le constitutionnel fondamental, qui consiste \u00e0 identifier et \u00e0 d\u00e9noncer les violations des droits.
