width=\u00a0\u00bb1\/1&Prime; tablet_width_inherit=\u00a0\u00bbdefault\u00a0\u00bb animation_type=\u00a0\u00bbdefault\u00a0\u00bb bg_image_animation=\u00a0\u00bbnone\u00a0\u00bb border_type=\u00a0\u00bbsimple\u00a0\u00bb column_border_width=\u00a0\u00bbnone\u00a0\u00bb column_border_style=\u00a0\u00bbsolid\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb text_direction=\u00a0\u00bbdefault\u00a0\u00bb]L\u2019Association canadienne des libert\u00e9s civiles (CCLA) exprime de s\u00e9rieuses pr\u00e9occupations concernant le projet de loi 97 de l\u2019Ontario, la <em>Loi sur le Plan pour la protection de l\u2019Ontario (mesures budg\u00e9taires),<\/em> avertissant que cela \u00e9roderait consid\u00e9rablement le cadre des droits \u00e0 l\u2019information de l\u2019Ontario \u00e0 un moment o\u00f9 la vie priv\u00e9e et la transparence gouvernementale subissent d\u00e9j\u00e0 une forte pression.<\/p>\n<p>Le projet de loi 97 exclurait <a href=\"https:\/\/www.ipc.on.ca\/en\/media-centre\/news-releases\/statement-commissioner-patricia-kosseim-proposed-changes-ontarios-freedom-information-and-protection\">de larges cat\u00e9gories<\/a> de dossiers gouvernementaux des lois ontariennes sur l\u2019acc\u00e8s \u00e0 l\u2019information. Certaines des exceptions propos\u00e9es s\u2019appliqueront m\u00eame r\u00e9troactivement, permettant au gouvernement d\u2019\u00e9viter les ordonnances d\u2019acc\u00e8s \u00e0 l\u2019information existantes et les d\u00e9cisions judiciaires. <\/p>\n<p>Le droit d\u2019obtenir de l\u2019information sur des questions d\u2019importance publique est prot\u00e9g\u00e9 constitutionnellement et constitue une pierre angulaire de la d\u00e9mocratie. Cela sous-tend le principe que les gouvernements doivent \u00eatre transparents et responsables envers le public. <\/p>\n<p>En pratique, ce droit d\u2019acc\u00e8s \u00e0 l\u2019information \u2014 ainsi que les cadres juridiques qui le soutiennent \u2014 permettent aux journalistes, chercheurs et organismes de surveillance de d\u00e9noncer les fautes et la mauvaise gouvernance.<\/p>\n<p>D\u2019autres changements propos\u00e9s supprimeraient les outils publics essentiels utilis\u00e9s pour v\u00e9rifier si le gouvernement respecte ses exigences en mati\u00e8re de vie priv\u00e9e et de cybers\u00e9curit\u00e9, et prot\u00e9geraient la prise de d\u00e9cision gouvernementale de l\u2019examen ind\u00e9pendant du r\u00e9gulateur ontarien de la vie priv\u00e9e.<\/p>\n<p>Tamir Israel, directeur du programme de confidentialit\u00e9, surveillance et technologie de la CCLA, a fait la d\u00e9claration suivante :<\/p>\n<p>\u00ab Le projet de loi 97 repr\u00e9sente un recul important du r\u00e9gime ontarien en mati\u00e8re de transparence et de vie priv\u00e9e gouvernementales. Malgr\u00e9 son nom, les seules personnes que la \u00ab Loi sur le Plan pour la protection de l\u2019Ontario \u00bb prot\u00e9gera sont les fonctionnaires qui tentent d\u2019\u00e9chapper \u00e0 la responsabilit\u00e9 publique dans leurs processus d\u00e9cisionnels. Son \u00e9rosion de la vie priv\u00e9e et du contr\u00f4le de la cybers\u00e9curit\u00e9 expose les renseignements personnels de tous en Ontario au risque d\u2019abus. \u00bb <\/p>\n<p><span style=\"color: #1e5799;\"><strong>Contexte<\/strong><\/span><\/p>\n<p>Le r\u00e9gime ontarien du droit \u00e0 l\u2019information \u2014 \u00e9nonc\u00e9 dans la <em>Loi sur la libert\u00e9 d\u2019information et la protection de la vie priv\u00e9e<\/em> (FIPPA) et son homologue municipal, le MFIPPA \u2014 conf\u00e8re au public un droit l\u00e9gal d\u2019obtenir des dossiers gouvernementaux et prot\u00e8ge les renseignements personnels. Ces lois sont supervis\u00e9es par le commissaire ind\u00e9pendant \u00e0 l\u2019information et \u00e0 la vie priv\u00e9e de l\u2019Ontario. <\/p>\n<p>Le projet de loi 97 minera ce droit l\u00e9gal d\u2019obtenir des documents gouvernementaux ainsi que les protections de la vie priv\u00e9e personnelle dans ce r\u00e9gime.<\/p>\n<p><span style=\"color: #1e5799;\"><em>Bloquage de l\u2019acc\u00e8s aux dossiers du personnel minist\u00e9riel et <span style=\"color: #1e5799;\">policier<\/span><\/em><\/span><\/p>\n<p>L\u2019un des \u00e9l\u00e9ments les plus pr\u00e9occupants du projet de loi 97 est sa proposition d\u2019exclure tous les dossiers d\u00e9tenus par le premier ministre, les ministres, les \u00e9lus et leur personnel politique des lois sur l\u2019acc\u00e8s \u00e0 l\u2019information.<\/p>\n<p>Le gouvernement de l\u2019Ontario a sugg\u00e9r\u00e9 que retirer ces cat\u00e9gories de documents des lois sur l\u2019acc\u00e8s \u00e0 l\u2019information est une pratique courante \u00e0 travers le Canada, mais cette caract\u00e9risation est trompeuse. Bien qu\u2019il soit raisonnable de prot\u00e9ger des informations v\u00e9ritablement personnelles, confidentielles ou li\u00e9es \u00e0 la circonscription, la FIPPA contient d\u00e9j\u00e0 des dispositions qui traitent de ces pr\u00e9occupations sans restreindre largement l\u2019access. <\/p>\n<p>Les exceptions propos\u00e9es ne sont pas non plus limit\u00e9es aux documents qui auraient un impact sur l\u2019activit\u00e9 li\u00e9e \u00e0 la circonscription ou la vie priv\u00e9e des tiers. Les exceptions sont de nature \u00e9tendue \u2014 les ministres et leur personnel ne seront exempt\u00e9s de divulguer aucun dossier sous leur garde. <\/p>\n<p>L\u2019Ontario applique \u00e9galement r\u00e9troactivement son exclusion des dossiers minist\u00e9riels, ce qui signifie que les demandes existantes d\u2019acc\u00e8s \u00e0 l\u2019information, les ordonnances de divulgation et m\u00eame les d\u00e9cisions judiciaires seront invalid\u00e9es, et que les dossiers gouvernementaux d\u00e9j\u00e0 soumis \u00e0 la divulgation \u00e9viteront l\u2019examen public.<\/p>\n<p>Comme l\u2019a soulign\u00e9 la commissaire \u00e0 l\u2019information et \u00e0 la vie priv\u00e9e de l\u2019Ontario dans son \u00e9valuation des changements, ces r\u00e9formes ne visent pas \u00e0 prot\u00e9ger l\u2019information des \u00e9lecteurs, mais \u00e0 <a href=\"https:\/\/www.ipc.on.ca\/en\/media-centre\/news-releases\/statement-commissioner-patricia-kosseim-proposed-changes-ontarios-freedom-information-and-protection\">\u00e9viter la responsabilit\u00e9 publique<\/a>.<\/p>\n<p>Le projet de loi 97 introduit \u00e9galement des changements qui mineraient la vie priv\u00e9e et limiteraient le contr\u00f4le de l\u2019utilisation des technologies par le gouvernement.<\/p>\n<p><span style=\"color: #1e5799;\"><em>Permettre aux fonctionnaires publics de conserver des documents num\u00e9riques dont ils n\u2019ont plus besoin<\/em><\/span><\/p>\n<p>Un autre amendement permettrait aux fonctionnaires publics d\u2019emporter avec eux leurs courriels, documents \u00e9lectroniques, messages instantan\u00e9s et plus encore lorsqu\u2019ils changent de r\u00f4le gouvernemental. Cette proposition nuit non seulement \u00e0 la vie priv\u00e9e en accordant aux fonctionnaires gouvernementaux l\u2019acc\u00e8s \u00e0 des informations dont ils n\u2019ont plus besoin pour leur travail, mais compromet aussi consid\u00e9rablement l\u2019acc\u00e8s \u00e0 l\u2019information. <\/p>\n<p>Les demandes d\u2019acc\u00e8s \u00e0 l\u2019information sont g\u00e9n\u00e9ralement adress\u00e9es \u00e0 des d\u00e9partements sp\u00e9cifiques, qui recherchent ensuite les dossiers sensibles sous leur contr\u00f4le. Permettre aux fonctionnaires gouvernementaux d\u2019emporter les dossiers du d\u00e9partement avec eux lorsqu\u2019ils partent les fait sortir ces documents du contr\u00f4le du d\u00e9partement, ce qui cache effectivement ces documents des droits ou des recherches d\u2019information dirig\u00e9es vers ce d\u00e9partement. <\/p>\n<p><span style=\"color: #1e5799;\"><i>Prot\u00e8ge les entreprises ayant acc\u00e8s \u00e0 l\u2019information \u00e9tudiante contre toute surveillance<\/i><\/span><\/p>\n<p>Un amendement pr\u00e9occupant permettrait au gouvernement de cacher quelles entreprises priv\u00e9es ont obtenu l\u2019acc\u00e8s aux renseignements personnels des \u00e9tudiants ontariens lorsqu\u2019elles r\u00e9pondent \u00e0 des demandes de documents.<\/p>\n<p>L\u2019adoption rapide et n\u00e9gligente des <a href=\"https:\/\/www.ipc.on.ca\/en\/media-centre\/blog\/use-edtech-schools-children-should-not-have-swap-their-privacy-education\">plateformes EdTech<\/a> a expos\u00e9 les renseignements personnels sensibles de millions d\u2019\u00e9tudiants au <a href=\"https:\/\/norma.lexum.com\/ipc-cipvp\/privacy\/en\/item\/522177\/index.do\">Canada<\/a> et <a href=\"https:\/\/www.hrw.org\/news\/2022\/05\/25\/governments-harm-childrens-rights-online-learning\">\u00e0 travers le monde<\/a> \u00e0 de graves atteintes \u00e0 la vie priv\u00e9e. La capacit\u00e9 de savoir quelles entreprises obtiennent l\u2019acc\u00e8s aux renseignements personnels de nos \u00e9tudiants est essentielle pour \u00e9valuer les risques associ\u00e9s \u00e0 la vie priv\u00e9e et \u00e0 la cybers\u00e9curit\u00e9, ainsi qu\u2019\u00e0 \u00e9valuer plus largement <a href=\"https:\/\/themarkup.org\/the-breakdown\/2023\/04\/27\/takeaways-from-our-investigation-into-wisconsins-racially-inequitable-dropout-algorithm\">l\u2019\u00e9quit\u00e9 des outils d\u2019IA adopt\u00e9s par le gouvernement<\/a> appliqu\u00e9s \u00e0 nos \u00e9tudiants.<\/p>\n<p><span style=\"color: #1e5799;\"><em>Exon\u00e9ration des \u00e9valuations <span style=\"color: #1e5799;\">gouvernementales en cybers\u00e9curit\u00e9<\/span> de la divulgation<\/em><\/span><\/p>\n<p>Un autre amendement exempterait cat\u00e9goriquement les \u00e9valuations de cybers\u00e9curit\u00e9 du secteur public des exigences de divulgation publique. Bien que des d\u00e9tails susceptibles de compromettre la s\u00e9curit\u00e9 puissent l\u00e9gitimement \u00eatre retenus, cette exemption propos\u00e9e s\u2019applique aux \u00e9valuations qui ne repr\u00e9sentent aucune menace pour la cybers\u00e9curit\u00e9.<\/p>\n<p>Par exemple, \u00e0 la suite d\u2019une faille de s\u00e9curit\u00e9, <a href=\"https:\/\/www.cbc.ca\/news\/politics\/cyber-defences-ag-cse-9.6946646\">les plans documentant l\u2019\u00e9chec du gouvernement \u00e0 adopter des garanties essentielles<\/a> seraient exempt\u00e9s m\u00eame si les lacunes de s\u00e9curit\u00e9 qu\u2019ils d\u00e9crivent avaient \u00e9t\u00e9 corrig\u00e9es il y a des ann\u00e9es. Le r\u00e9sultat final serait une perte de responsabilit\u00e9 et une r\u00e9duction des incitatifs \u00e0 adopter des approches plus robustes en cybers\u00e9curit\u00e9.<\/p>\n<p><span style=\"color: #1e5799;\"><em>Moins de surveillance et de transparence de la vie priv\u00e9e gouvernementale  <\/em><\/span><\/p>\n<p>Un dernier ensemble d\u2019amendements prot\u00e9gerait <a href=\"https:\/\/www.hrw.org\/news\/2025\/04\/17\/doges-growing-reach-personal-data-what-it-means-human-rights\">le partage d\u2019informations<\/a> gouvernementales contre la surveillance du commissaire \u00e0 la protection de la vie priv\u00e9e et mettrait fin \u00e0 l\u2019obligation du gouvernement de l\u2019Ontario de publier des d\u00e9tails sur les types d\u2019informations personnelles trait\u00e9es et pourquoi.<\/p>\n<p>Collectivement, ces mesures cr\u00e9eraient d\u2019importantes lacunes dans le cadre de la vie priv\u00e9e et de la responsabilit\u00e9 publique de l\u2019Ontario.
